Such a shame. I hate seeing businesses go under, especially ones that respect their staff so much :hihi:

 

I watched the news last night and the business people were getting gobby threaten job cuts etc. It was so predictable. It's always the same with these people, they don't mind pushing people around but when they get a taste of their own medicine then they don't like it and yelp the longest and loudest. This was a decent topic fit for open discussion until that idiot tried to turn it into a troll.

Yesterday on Radio 4 a union official said that the judgement applies to compulsory overtime not voluntary overtime.

 

If this is true then fair enough. If not then no, I don't see why OT should contribute to holiday pay entitlement. What if there was no OT available on the week you had off? It's not like you could (or indeed should) be able to claim extra pay for weeks where you don't do any OT.

 

Consider the following:

Employee A and B both work the same hours, in the same job, and do the same amount of overtime. Employee A takes a week off and has his holiday pay calculated to include his OT so get his basic pay plus average OT. Employee B works that week but there is no OT available so only gets his basic pay, i.e. less than employee A. In what way if this a fair agreement?
