Swampster 10 #14 Posted February 14, 2013 I think it's a ploy myself to push people towards the subs based 365 version. If they only had this license model their sales would drop through the floor.. and deservedly so.
 Share this content via...

swarfendor437 14 #16 Posted February 14, 2013 In the EU transferring a software program from one device to another is perfectly legal, as is also selling it to another user, provided it is only installed on one device at anyone given time. 1991 EU computer software directive. Article 4(2) of Software Directive2: “The first sale in the Community of a copy of a program by the rightholder or with his consent shall exhaust the distribution right within the Community of that copy …”. http://cheeks-co.com/when-is-a-software-license-transferable-even-if-it-says-it-is-non-transferable-byrt-prinsley/ The sale of a program is not how Microsoft operate - they provide you with a licence to run their software on your computer, in much the same way that Apple do with MacOSX. http://www.gnu.org/fry ---------- Post added 14-02-2013 at 23:42 ---------- Microsoft's tech support people didn't seem to know their arses from the elbows and gave several conflicting answers. Oh, so true. Take Office 2007 (remember M$ espouses integration?) where Word has 'draft view' - the Excel team retained 'normal view' from previous versions of Office! - in fact a reporter for Linux User & Developer visited the M$ Office Teams and the Word Team try to score points off the Excel team - so much for integration! Which has to comply with the laws in the respective country of sale so some parts may not be enforceable. The Microsoft license agreements also normally state that fact. Dardandec 32 #18 Posted February 15, 2013 The sale of a program is not how Microsoft operate - they provide you with a licence to run their software on your computer, in much the same way that Apple do with MacOSX. Software companies cannot prevent the sale of “second-hand” software licences, where those licences are for a one-off fee and an unlimited period. Clauses in these licences stating that they are non-transferable will not be enforceable. This is the effect of a recent judgment by the Court of Justice of the European Union in the case of UsedSoft GmbH v Oracle International Corp. (3 July 2012). The case is based on EU competition law “exhaustion of rights” principles according to which, once a product incorporating intellectual property rights has been sold inside the EU by the rights-owner (or with his consent), the rights-owner cannot object to the product then being sold to someone else. The European Court has now looked at how that principle applies to software licences. http://cheeks-co.com/when-is-a-software-license-transferable-even-if-it-says-it-is-non-transferable-byrt-prinsley/
 Share this content via...
