Child Support Help

Hi, I am just wondering if anyone can help.

CSA are going to be taking £350 a month from my partners wages for 2 children he has with his ex. He only earns £1080 a month, over £800 pound of that goes on bills. We have a child he has to support and I am on Incapacity benefit so my money isn't enough for us to live off.

 

My partner has tried to explain to them that we can't afford to pay all that but they won't listen to him, they say he has to. They have worked out the amount from the information his ex gave them, not from us.

 

Does anyone know how we can get help to sort this out? It is going to split our family up an maybe make me and my child homeless if we can't sort this out

to be honest csa doesnt really care how you have to live or if it splits families up..he's got to pay no matter what... sounds harsh but theres absolutely no way of getting out of it..unless he gives up his job.. which of course he cant do that... if he can come to some sort of agreement with his ex..all she has to do is contact csa and say we come to an agreement and she doesnt need csa to intervene anymore...but he has to get her to agree first of course... hope things get sorted for you soon though x

csa are useless for both sides, see a solicetor on the greenform scheme. the child poverty action group are very good.

does that amount include any arears?

 

i advise you see a solicitor, but to be honest the CSA seem to be a law unto themselves

Contact your nearest Citizens advice Bureau.Although £350.00 a month is not a huge amount as they are his kids too.However contact the CAB.

i get child support from ex wife. if i could turn back time id have never got the csa involved. cpag are good.

Hi thank you for your replies an suggestions. We will try everything you have said.

 

It does include arears. We have had letters from them for years saying we do not owe anything, then a coupe of weeks ago we got a letter saying he has £7000+ debt. They haven't taken any information from him, just his ex. They have not let us know how they came up with that amount. All they did was tell us they are taking £350 a month from his wages.

We tried the CS Calculator an it worked out he should only be paying £30 a week for the 2 children.

 

Also does anyone know if they take his exs partners earnings into account when they work it out? They are on over £50,000 a year. My partner only earns £12,000.

You have to make sure they are including your child in to account http://www.csa.gov.uk/en/PDF/leaflets/new/CSL303.pdf page 15 says they will have to ignore £162 of his wage. So should only take £183 a month + any back pay.

 

The important thing is to let them know of the addional child he is having to look after.

IIRC, they take 20% for 2 kids, but due to the arreas they will try and screw you to clear them faster.

 

As for taking the ex partner's salary into account, thats a no, in their eyes the NRP(Non resident parent) is evil and must suffer at their hands.

 

They also specialise in causing as much grief as possible between you and your ex including lying to both of you.

 

Another thing that ****** me off they will try and take your overtime into account too.

No, the ex can be a multimillionaire living in a palace while you and your partner lived in a shoebox and they would still want their pound of flesh.

 

My advise is not to bother with a solicitor or the CAB, neither will be able to help you as the CSA will ignore the CAB and solicitors will not even want to bother with the CSA as they know they cant win.

 

You will have to fight this yourself and if you want support, your local MP is your best bet.
