logiebaird Posted January 8, 2007 Share Posted January 8, 2007 Anyone know of any solictors in N Sheffield who do free consult or are there any advice centres still have a solicitor ? - Case is appeal against motoring offence which relied on police video recorded 14 days after event to illustrate where the road signs / speed restrictions had been sited 14 days earlier in road works on Tinsley Viaduct. Mel's Mum Posted January 8, 2007 Share Posted January 8, 2007 Legal Aid is now means tested so if you are in employment you wouldnt be eligible for a free consult. Even if you are unemployed, there is also a merits test for legal aid and motoring cases, such as the one you describe, do not usually pass the merits test. I E would it be worth me driving down the same road now when the road works have vaccated to show that there is in fact no speed restriction ? - at what point does a video cease to be relevant ? However if i troop out to Tinsley viaduct today and video it then the wind will have altered the positions or the roadworks will have been completed. There has to be an element of common sense that roadworks (even in Sheffield ) will progress. Your question as will mine in court be - y wait 14 days to video a "crime" scene and what is the point of deploying 2 videvar trained police officers to a video equipped vehicle and then not having a real time video ?. Stormy Posted January 15, 2007 Share Posted January 15, 2007 This might be completly incorrect but you could try asking the council to see if there are any traffic cameras looking over the area showing footage of the roadworks with the signs in their original position? There are traffic cameras all over the place now, perhaps the footage is covered by the FOI ie if you want to look at it, you have the right to?
