Legal action, might get sued

On numerous threads on SF the reason for not doing things or making silly rules cited by companies, local authorites, SF posters, trade organisations, PC brigade etc is that someone might get sued, these articles are full of words like, could, might, if, possibly, may, what if, etc. Are people really living in fear that there is a danger in everything we say or do either of offending someone, injuring someone, damaging something that we may get sued? Even SF sometimes deletes posts for fear of upsetting someones sensibilities and being sued.

 

I think this sueing thing is just another myth to generate fear and money and keep everyone under control from dangers that don't really exist. The public has been brain washed into paying out huge amounts of money, for example to have things checked and serviced because they might kill them or burn the house down and they might get sued but how often do those things actually happen?

 

How often do people actually get sued for these things, I think it's very rare.

Yes it is; but it only has to happen once. One forum owner gets bankrupted by being sued for something that appeared on his site (and he doesn't have to lose the case in order to be bankrupted!) and Geoff is going to make damn sure he doesn't ever become the second one.

 

 

And although I for one believe that it's gone way too far, I don't honestly see what can be done about it. I've considered before now, a policy whereby the plaintiffs and their lawyers can be convicted of wasting the court's time when these cases finally turn up; and costs can be awarded against the plaintiff's lawyers and not the plaintiff himself. Of course if you do THAT, then a huge number of people who have a legitimate grievance will be unable to find a lawyer who's prepared to fight it for them; you might well be making things worse in the opposite direction, than they are now.

Maybe this happened in a particularly bad area?

 

I think the police officer in the video summed it very well when he said that he thinks that "our moral values have changed and we have no regard for one another".

What would have been the legal repercussions for someone who phoned 911 for the poor man. I just don`t understand how people can be so uncaring. If I saw someone in trouble I just couldn`t do nothing. It`s not necessary to put yourself in danger by getting physically involved but a phone call ? How dangerous is that?

Its shocking to see people drive round and away from a person in need, the pedestrians did go to the guy and I presume would have rang the emergency services (the time available for them to do so was around 30 seconds before a patrol car passed and stopped), it is likely they were still in shock.

Never been in that position myself, but I would definately ring 999/112. Not long since me and a mate were walking through the woods at bottom of manor (bowden?) and there was a guy drunk and half unconscious, we carried him out of the woods and rung him an ambulance.

The likelihood for being sued is slim - unless you are a multinational, a Government funded service(school or hospital) or a lottery winner.

The payout from Joe Public really wouldn't warrant a civil action in most cases I wouldn't have thought.

Everything is someone else's problem and people make excuses for not acting upon things which is why things are as they are with nearly everything nowadays and we are abused for it, particularly by the government because we let them and they know that no one will stand up against them. Only to read some of the stuff on SF and people are scared witless of the slightest little thing.

If you're aware of the Gina Ford /netmums fiasco, where Gina Ford, babycare 'guru' was planning to take netmums, a hugely popular parenting website to court, you'll know why it's worth being careful.

 

On this very Forum you'll find mention of Gina and her techniques must be got round very circumspectly, freedom of speech be darned. The whole fiasco was a threat to free speech on the net, and netmums ended up paying a five figure sum to settle.

 

All because someone with money and power decided she didn't like what a member of the public said about her techniques on a public forum .
