jodyh86 Posted November 4, 2006 Share Posted November 4, 2006 as some of you will no i had 4 kittens that i was rehoming for my friend,anyway she had to find homes asap and as she wasnt alowed home and they were pretty much left on there own i sed me and my mum would take them and find homes for them which she agreed was best. anyway my brother took 2 kittens and we decided we just couldnt part with the other 2 as wed fallin for them and decided we could provide a good home for the pair of em.anyways all good there doing really well and there great. ok so now the problem my friend has texted me 2day she asked how the kittens are(the first time shes asked in nearly a week)i sed there great my brother has 2 and weve decide to keep 2 others to which she sed "oh i told you to save me 1 for someone" to which i obviously replied well you havent been in touch for nearly a week and i told you to give my number to your friend to arrange coming and having a look at them and besides which you asked me to find homes for them which i have and they cant be split now as it wouldnt be fair and there really happy. her reply was well someones giving me £25 for one and £10 for the other.i told her basically that if her friend wanted one then i no some1 who is giving somemore kittens away,then i had her boyfriend(who was the reason she had to get rid of them in the first place!!!! )textin me sayin me to get them ready as he was coming for them and they wernt ours! well obviously my mum rang him and gave him a right earful.and hes text me since sayin there his he has the right to take tham as hes cared for them(even tho in my opinion they wernt in the best shape they smelt and where slightly underweight! )and hes basically sed if i want them then i have to pay them £50 so she can pay the people bk who have supposedly bought a kitten(which imo is a load of rubbish as she told me £35 and she sed "i told you to save me 1") so hes uppped the money. the thing im scared of is he is a bit of a nutter and he may try and brake into my house to pinch them bk or put my windows through,ive since ignored the texts but i just dont no what to do,me and mum are adament that were not giving them bk as there ours now(weve provided food,worming,flea treatment!)and y should i be bullied into giving them money or risk having the kittens piched?? :( :help: Link to comment Share on other sites More sharing options...

They can't suddenly decided that they want them back it doesn't work like that. I'm not sure where you stand legally but i'm sure that no-one would believe they are in the right. stick to your guns. Did she tell you to charge for them in first place? It would only upset the kitties to have them go back to them to be sold on again. Sounds like they are just trying to make some extra money. Perhaps someone has suddenly offered them more money? You could always ring the police on the non emergency number and ask their advice. This would stay on the computer so if they did cause any trouble the police would know the story. I can't see him causing any criminal damage to get them back, his aim to to make money not to spend it but he may threaten to do so if he is that type, again tell the police about it. jodyh86 Posted November 4, 2006 Author Share Posted November 4, 2006 no she didnt tell me to charge she just sed find good homes for them.on sunday she sed her boyfriends mum wanted one but i sed it was too late and she sed ok it dunt matter but if you can try and save me 1 for my friend us i think she wants one!i couldnt hold onto them forever so ive found nice new homes for them now.what would she have sed if id told her theyve all gone i havent got any here now??!! i think im just gunna hold on and see if anything else gets sed,ive no idea y shes wanting £25 for one and £10 for the other she claims these ppl have already paid the money which is crazy no one pays money without seein them first do they?! i was going to go out 2night but i think im best stoppin in just in case.its just crazy that she asked me to get homes for them and now shes deciding they want em bk!at the end of the day shes just as bad as him trying to con money out of me knowing im not going to give them bk what they dont no is im not stupid enough to be fooled like that:rant: hes got locked up b4 for robbing houses thats y im a bit woried. We encounter problems over the legal ownership of animals quite regularly at the Shelter, which is why we ask all owners to sign the animals over to us so that they are aware that they are committing themselves to relinquishing the right to decide what happens to the cat after they have entered our care. Even then there are potential questions to be asked with regard to what happens when people find a cat that is apparently a stray- does that cat still actually belong to the owner that lost them? Or to the person who found them and committed them to our care? In your case I have to think that your friend's verbal agreement with you that you would find suitable homes for the kittens, combined with her physically giving them to you, would be taken as some sort of a contract in law, even if there was some sort of misunderstanding in that process. If she asked you to find homes for them, and you have done that, then you have done the best that you can to fulfill her original request. Link to comment Share on other sites More sharing options...

I would still ask for police advice, I once had some trouble over a cooker and he was threatening me so i phoned the police for advice and they were very helpful, then when he turned up at the door they knew the story and dealt with it straight away. If he already has a criminal record, he won't want the police getting involved! he's just trying to scare you, try not to worry too much and focus on the little sweeties you have rescued from these obvioulsy horrible people! It's sad but true, always sign an agreement as you can't prove a verbal agreement. I really hope this gets settled and you can keep the cats away from these terrible people. I would still ask the police for advice - do you have any vets bills/receipts from things that you paid for for the cats - it may help to prove the fact that you had these cats in your care all this time. Or, try suggesting that you will pay them their 35 pounds to keep the cats, if they give you 40 pounds for expenses whilst looking after the kittens, tell them you have receipts and refuse to part with them until you receive the money you spent - it might put them off.. you never know. technophobe Posted November 6, 2006 Share Posted November 6, 2006 As far as I am aware if you have entered into a verbal agreement over sales of the kittens(property) and have handed over the money for them then they are now your property. This is definately not a police matter and would be classed as civil. I think it is wise however to report the incident over possible future threats to the police, which you have, just so a running log can be kept in case you need it. As I said it is a civil matter. I would also recommend you take the kittens to the vets to get them recorded in your name as owner as this will add some credence to your case should it be needed at a later stage.
