Witnesses needed - somebody bumped my Corsa!

Did anyone witness an Orange Ford Fiesta which overtook me on the left at the junction of Birley Moor Road/Birley Lane today at 4.40 pm and took off my wing mirror?

 

The chap did stop and we exchanged details, but he said the fault was half mine - because I should have ovetook the car in front of me (who had paused to turn right onto Sheffield Road) - I was waiting behind this car and the driver who clipped me said he thought I was turning right - even though I had no indicator on!

 

I accept that it could be partly my fault - but not HALF!!! OH NO!!

Are you saying that he "undertook" you on this junction ??? and then suggested it was your fault???

 

2 questions:

 

No 1

were you waiting patiently (as he /she described it to turn right) - when this person took your wing mirror ??? cos of so !!!!

 

No 2

Had you started to move from the "waiting behind a right turner" position when the wing mirror collison took place ???

 

The answer to one of these questions holds they key to who's fault if anyones it was - always remember that an indicator is only what it is called !! an indicator -- cannot be used - or its unuse be used as an argument

This is how I read your description, correct me if this is wrong?

 

You were in the right hand lane and got trapped behind a car waiting to turn right. Because you didn't intend to turn right and didn't want to wait for the car to move out of the way, you decided to switch to the left hand lane. You therefore started to go into the left hand lane and did so without indicating or looking to see if the left hand lane was clear. The driver who was already in the left lane under took you and clipped your left left wing mirror off in the process.

 

Mmmm... if that what happened then I would say you are 100% at fault and you are very lucky it wasn't more than just a wing mirror.

Yes, I am going to correct you if you are wrong!!!! :rant: :rant: :rant: :rant: I didnt switch to the left hand lane!! When the car in front had moved off, I was just about to go straight on - there wasn't a left hand lane - just one lane! - the car in front of the one that clipped me very nearly clipped me too - but just drove on.

The one that actually clipped me and stopped said "I thought you were turning right - I just followed the other car through" It all boils down to impatience and neither of them could wait for me to move out of the way - just decided to "overtake" me on the left. I didn't indicate either left or right because I was going straight on - in the one lane!

1. Yes - I was waiting patiently

 

2. Not sure about this one - if i had started to move - it would have only been very very slight - and only moving forwards - not left or right!

 

I would like to add that the chap more or less said that it was 50/50 - cos I should have overtook the car turning right, and he should not have overtook me. He said he was sorry!

 

Anyway, my wing mirror is now back in place, the scratch down the side has "rubbed off" and his slight damage to his right-hand repeater is easily mended. It has all ended amicably with no insurance claims etc.
