A few days ago I was involved in a car collision where my wife suffered a broken collar bone. Because I went into the back of the car in front, I admitted liability. yummyyumyum Posted September 8, 2006 Share Posted September 8, 2006 your passanger can claim for injury, i know this as my brother was in a accident that could have been either parties fault but insurance found him at fault, his passanger( a neighbours relative) claimed from his insurance for whiplash injury. this did put up my brothers insurance by quite a lot but as dark moomin says if the injury is genuine and will be at a financial loss why shouldnt she claim? Dark Moomin Posted September 8, 2006 Share Posted September 8, 2006 Actually, as long as he has third party liability as part of his insurance cover (which is basically a major part of why insurance is compulsory) he will be covered for injuries to passengers, and so yes, in theory she could make a personal injury claim against him, and his insurance would pay it - not him directly. Of course this would increase the cost of the claim and therefore also his insurance. However, if she is going to be financially worse off because of her injury may be worth claiming. Had a friend whose supposed mates claimed off her cos they had sore necks fior a few days!! However, it does seem a little backward to do this, but I'm not certain its a scam as such. You are the reason insurance costs so much Thanks for that useful advice, have you ever thought of starting a Citizens Advice Bureau. I was merely asking if she was legally entitled to claim. If she is then she / we'll consider it, if not then so be it. As for it being an insurance fiddle......................."I know dear, I'll crash the car, injure you, posiibly seriously I don't know, then, if and when you get out of hospital, you claim damages from my insurance and we'll have a week at Torquay with the cash" ????????????????? brain in neutral, mouth in 3rd.
