I'm wanting to take my old employees to court, is there anywhere in sheffield that doesn't ask for money upfront? i asked irwin mitchell they said yes they can help as i have a good case however they need £250.00 upfront!!

 

i've not got that kid of money spare at the moment. can anybody help!!

 

i'll even give them 20% of my winnings if they pay this fee!!!

You might be able to find a firm that will take on your case on a no win no fee basis. And if the court feels it is justified, if you win they might order the other side to pay your legal fees, so you win a lot, but don't pay a lot out.

 

BUT!!! If you do this and you lose you might have to pay the fees for the other side and you might have to pay the court fees.

 

So its a case of weighing up how likely you are to win.

 

May I ask what the issue is? I'm interested in the Law, though I'm not a solicitor yet. Or am I just now being nosy?

First of all, before you commence legal proceedings, have you exhausted all of your ex-employer's procedures for dealing with the issue? For example, if you have been dismissed, have you appealed and taken it as far as possible with them? If you are claiming constructive dismissal have you raised a grievance? And if you didn't agree with the outcome of the grievance investigation then did you appeal against it?

 

All employers must follow statutory disciplinary and grievance procedures. If an employee brings a tribunal claim without having exhausted these then this will automatically result in a deduction from any compensation awarded in their favour.

 

If you have done all the above then take a look at the following website. If you are on low-income you may be eligible for legal aid, etc.

You’re a Star!!! Yes I’ve exhausted the Grievance procedure, and each time they come back stating the managers hasn't done anything wrong ha-ha

 

I've now completed the calc and I can get Help thank you!!

 

Long story short, I worked for a company one side residential the other side business. I worked n resi fro 3.5 years, and they loved me, always hitting targets, never late, always doing extra things...

 

Went over to business they put managers in charge of us who had no idea how to manage a team, neither the higher manager. I was off work to work related stress came back they didn't look after me, ended up going off with depression, saw a councillor, came back 2 months later off again with depression, due to victimisation

 

Now left company and feeling 110%
