The key is the quality of the appointee. Most of the judges who make it to the top tend take the duty quite seriously and show a first loyalty to the law/constitution rather than the president who nominated them or personal beliefs.  There are other alternatives like fixed terms and drawing the members at random from the federal judges. They might produce a "better" court which is harder to stack with court with judges of a particular opinion.
 Share this content via...
Delbow   699 #75 Posted April 9, 2021 Surely the best option would be to make appointments independent and the judiciary independent of politicians. It's a farce how both parties try to load the court with their appointments and then pray they'll live for ages.
 Share this content via...

During Trump's last year left leaning judge Ruth Ginsburg died 6 weeks before the election and the Republicans rushed through a right wing replacement with indecent haste in five weeks - appointing her one week before the election.  The Republicans have unbalanced the supreme court with three appointees under Trump's presidency, it's not surprising that the Democrats want to, at least partially, restore that balance. Apparently it's the 'any way method' of obtaining guns that Joe Biden is addressing. Starting with a crackdown on the proliferation of so-called ghost guns, or firearms assembled from kits.  It's a start, and I hope he will go further. The 2nd Ammendment is ambiguous. Current (and previous) Supreme Court decision has interpreted in favour of the gun-owning lobby. A different minded court could see that the absence of any need to maintain a militia can remove the right to bear arms. Political appointment to the Supreme Court will always influence such decisions.
 Share this content via...
