Virgin Holidays. Breaking Their Own Rules?

Was due to fly out to Florida next weekend. Surprise, surprise they cancelled the flight.

 

Now they are not offering a refund desite this being in breach of their own T&Cs and against ABTA rules.

They are putting the onus on the customer to cancel and then reclaim from travel insurance.

 

We won't be doing this - we will be recharging to the credit card who will then recharge to Virgin.

Why should the travel insurance company pay out when Virgin are holding onto all the money?

 

If you are booked with them, I'd check your travel insurance.

Quotations from their website.

 

9.2. You can cancel your booking without paying cancellation charges if the performance of your package, or the carriage of passengers to your destination, is significantly affected by unavoidable and extraordinary circumstances [defined in their T&Cs as Changes occurring because of the recommendation of governments, international organisation, police or the foreign and commonwealth office; and all similar events outside of our control. ]. In such circumstances, we will arrange for your booking to be terminated and for you to receive a full refund. We will observe advice provided by the UK Foreign & Commonwealth Office.

 

10.2. Most changes are insignificant but occasionally, we may have to make a significant change. If we have to make a significant change or cancel, we will tell you as soon as possible. We will tell you the procedure for making your choice. Please read any notification of changes carefully and respond promptly as if you do not respond to us within the timescale given, your booking may be cancelled. We will offer you the choice of the following options:

(a) (For significant changes) accepting the changed arrangements, or

(b) Purchasing alternative arrangements from us, of a similar standard to those originally booked if available (if the chosen alternative is less expensive than your original one, we will refund the difference but if it is more expensive, we will ask you to pay the difference), or

(c) Cancelling or accepting the cancellation in which case you will receive a full and quick refund of all monies you have paid to us.

 

So basically they are breaching their own T&Cs...

As they've laid off some of their cabin crew for 12 weeks with no pay they'll be coining it in.

And they are asking for money from the Government like some of the other companies. Isn't it marvellous how these companies who were moaning when Flybe asked for help now do the same and it is ok.

I think it's positively amazing, how all these capitalists are now begging for socialists to save them  ;)

Think it's more capitalists begging for other capitalists to save them. 

 

If it was socialists saving them then the terms would include adjustments to how they interact with their staff, customers and wider society :)

Why should you possibly have to stand to pay a waiver fee to the insurance company when you can get it back for nothing via the credit card company.

No, I have insurance. I don't agree with companies not fulfilling their obligations because they don't have insurance.

 

But also, why should I lose out on my excess when I pay for my CC and the section 75 should cover me.

You obviously don't travel much - there is such a thing as excess.

And it is not unjustified - they have failed to deliver a contracted obligation and are now welshing out of the contract - in no other arena of business would they get away with this.

I have already said I have insurance, but that I don't see why I should have to pay excess for a breach of contract by a package holiday company who is now asking for a bail out from the government.

At least it is helping add to you post numbers - although looking through your constructive (?) comments in other threads, I do wonder if you are a troll bot.
