Mossway   15 #49 Posted August 4, 2017 (edited) A decent stretch of community service or something would be sufficient, a conditional discharge is abit too light.  For a first shoplifting offence most people get either a Fixed Penalty Notice or a Verbal Caution and don't even go to Court. Possibly she's got a bit of form for Shoplifting ! Edited August 4, 2017 by nikki-red fixed the quote
 Share this content via...
redfox   10 #50 Posted August 4, 2017 History repeats its self this week. Natalia Sikorska a business management student has escaped punishment for shoplifting goods valued at £960 . The judge told her that she was a student with a place at University and a woman of considerable talents .  Sikorski who also works as a business development manager was given a conditional discharge as the judge told her that she had a potentially bright future .  Mean while on the Manor!!!!!.    You could have put a link to the story so people might have a better idea what the facts were.  http://www.telegraph.co.uk/news/2017/08/03/model-tried-steal-1000-goods-harrods-given-slap-wrist-magistrate/  It was attempted theft - and yes it does make a difference to sentencing. You could have put a link to the sentencing guidelines so that people could assess if the magistrate has followed them or not.  https://www.sentencingcouncil.org.uk/offences/item/theft-from-a-shop-or-stall/2-theft-from-a-shop-or-stall/   There you go - now we can all be better informed. Mossway   15 #51 Posted August 4, 2017 (edited)  It was attempted theft -  There you go - now we can all be better informed.  The report said she was sentenced for Theft . Journos who write these stories use terms such as 'tried' to steal since she appears to have been apprehended before she got into, say, Knightsbridge. However the Theft can. take place actually in the shop. The Times also uses the term Theft as opposed to Attempt Theft re the sentencing Edited August 4, 2017 by nikki-red fixed the quote
 Share this content via...

Can you find a case where someone was jailed for a first offence?
 Share this content via...
Mossway   15 #55 Posted August 4, 2017 redfox I've read it again but can't see your actual quote. Nevertheless it seems the DJ has followed the Sentencing Guidelines etc ..... but I just wondered how it got to Court if she had no previous unless she had, presumably, not coughed it in her interview in which there's little alternative to charging her.  Cyclone, Custody rare for a first offence of Theft unless the amount is huge - or - if the defendant announces his intention not to comply with any non-custodial disposal such as Unpaid Work, Tagging etc,etc
 Share this content via...
Cyclone   10 #56 Posted August 4, 2017 Conclusion being that samssong didn't get the support he was hoping for in his argument here. The same rules that apply to the poor and unwashed were applied here to the well off and woman of considerable talents (whatever that double entendre is supposed to mean). But the poor unwashed ,uneducated , unloved ,downtrodden , hungry and angry among us may have an excuse for stealing the odd designer hand bag or a crust to fead the kids .  But you intellectual well bred citizens still find the need to support ( for instance the judge) folk of a similar upbringing and family wealth who steel just for the thrill of it and when they get caught the poor dears get a little rap on on the knuckle and told to be good girls and boys and please do not get caught in future:hihi:
 Share this content via...

You were complaining about unequal treatment, now you want to switch your argument and complain that the treatment is equal. We get that you have a reverse snobbery problem, you don't need to keep creating posts to prove it.
 Share this content via...
