ratter71   10 #40 Posted February 20, 2017 Given the severity of the crime would it not have been reasonable to push to have her remanded in custody? or even examined/detained under the mental health act??  The only section of the MHA the police can use alone is section 136 which is removal from a public place to a place of safety, after which Drs can detain for upto 72hrs, under all other sections (such as 135, which is removal from own home) the police cant act without either AMPs, Drs or a judge.
