Shengen visa advice

Good evening all,

We are planning a trip to Spain in August.My wife is a foreign national (Thailand)but has a u.k residence visa..Will she need to apply for a Shengen visa to enter Spain..?

It's such a serious question I would ask the relevant Government department, not a forum.

For the shengen visa you have to apply to the government of the first country you enter and it is free if you are the spouse of an E,U national.

The time of day wasn't the issue. You said you're not going till August so it's not as if the need is urgent. It's not a good idea to ask for specialist legal advice on an open forum where you could easily get loads of contradictory advice. Contact a government agency - Home Office, Spanish embassy, immigration specialist - and ask. Then you'll know what to do.

2nd hit on Google.

 

Family members of an EEA/EU National holding a valid UK Residence document do not need a Schengen visa to enter Spain, only if the following 2 conditions are met:

 

  • Travelling with/joining the EEA/EU family member in Spain (EU Directive 2004/38/CE, according to Real Decreto 240/2007, 16 February)
     
  • The UK Residence document literally bears the wording: Type of Document: "Residence Card of a Family Member of an EEA National"
