Do you have the right to buy the house from housing association?

You have the right to acquire, if that is written into the covenants/ tenancy agreement.

 

My own Housing Association property does not have the right to acquire, and this is written into the tenancy agreement.

You do have to be a tenant in the property to exercise that right, I think thats what the OP is asking for.

 

You can't just wonder down any old street, pick out someone elses house and try and buy it from the council.

@PT - is this covenant because your property is specifically for the disabled?

If so, this would perhaps be similar to the situation with local authority housing such as bungalows and downstairs flats which are designated for disabled and the elderly.

No, CCIT. this property has been adapted extensively, for me, but it's actually classed as "General Needs".

I had some arguments with them about the classification, when I asked for other stuff to be done, so that issue has been a bit of a sore point. (not for RTB, incidentally, as I, Personally don't agree with it, and would not, on pronciple, buy my social housing property)

 

I don't know about the last bit of your comment, I thought that any council houses could be sold under RTB, regardless, as I have seen shedloads of the council's disabled persons' bungalows and flats that have been bought, taking hem off the social housing market, permanently.

TBH I don't know for sure but I think that some properties designated for the disabled and elderly are exempt from RTB. I have seen ground floor flats that have not been sold, whereas the upstairs ones are in private ownership. I agree with you on the subject of RTB social housing. The policy has pushed folk towards the private rental market with associated higher rents which many can ill afford.

Many HAs are charities and therefore outside the RTB/RTA schemes.

You're quite right PT, but I believe Sheffield to be unusual in selling properties via RTB which were specifically suitable for the elderly, as they clearly didn't need to. Neighbouring councils Rotherham and Barnsley certainly didn't. The resultant lack of choice of suitable/desirable social rented homes here is probably the reason why many older tenants don't downsize. I don't know if the council are still including bungalows and ground floor flats within RTB but they sold off plenty in the past.

 

What the law says

You do not have the Right to Buy if your home:

• is particularly suitable for occupation by elderly persons, taking into account its

location, size, design, heating system and other features, and

• was let to you for occupation by a person aged 60 or over, whether they were the

tenant or not;
