Private Parking Ticket Megathread (Part 2)

I've recently won an appeal at POPLA for overstaying my alloted time in Pure Gym City Centre car park. Happy to provide my appeal letters to the parking company and POPLA if anyone would like.

Either wait it out, or send the same appeal letter again.

 

Who are Wright Hassal anyway?

 

Have you checked to see what the regulations are if you appeal against a ticket and get no response?

Saying it was placed on hold because of the case is rubbish, the case didn't have any bearing on your appeal because you were questioning the legitimacy of the ticket.

ok so my partner had parking ticket from just off bradfield road last April, appealed against it, got popla code etc and now many months later just received letter from Wright Hassal saying appeal was placed on hold due to the case of parking eye ltd v Beavis which was being heard in the supreme court, says they have been asked to contact us given the length of time that has passed since the appeal was logged, they have been asked to contact us to give us the opportunity to provide more evidence, we have 7 days to do so, we have given all the evidence we can though. advice please..:roll:

 

 

Did you submit an appeal to POPLA?

 

I've just had my appeal upheld by them. The basis of my appeal was that I did not receive a notice to keeper only a reminder letter. Because of this they could not persue the registered keeper of the vehicle as they didn't meet their duties under the protection of freedom act. There was also an error in the wording of high views documentation which also meant the appeal was upheld.

i submitted an appeal to popla and received code etc then got another letter july 2015 saying a further appeal has been filed to supreme court for a further hearing on November 9th 2015 and now got this letter from wright hassal. will type in a brief section of letter...

we have been appointed by the British Parking Association(BPA) to act as an independent appeals body, under the brand of POPLA, we are not instructed to act on behalf of either party.Your appeal has been marked as not GPEOL ( genuine pre- estimate of loss).

given the length of time since appeal was lodged please give further evidence. you have 7 days of date of letter..

We first got the parking fee in April last year.

Hi all,

 

Until I searched I didn't realise there had been so much discussion about the carpark at Broomhill (top of the shops).

 

Our company have a received an automated fine for a vehicle using the carpark and wanted some advice. This is the situation:

 

Saturday evening, 9pm. Driver drove into the carpark to take some pictures of the vehicle and did not realise there was a need to pay - carpark was completely empty and the driver did not park in a space or leave or lock the car.

 

Took some night pictures of the car and left after 20 minutes. No-one came into the carpark and there was not a single car using it.

 

Never thought anymore about it until a PCN arrived from Excel.

 

Should this challenged, ignored or paid?

I wouldn't be so fast. They are not listed on the Law Society and their only director (Mr Patrick Foster) seems to be a director for a few garage services:

Wonga got an absolute pasting when they were caught sending letters out from fake solicitors, it was seen as part of the behaviour that brought in the regulation to their sector.

 

I'm sure the practises of these companies will be viewed in much the same way.

Also worth noting that not just any old Joe can setup a solicitors:

 

Any new business established under the regulation of the SRA must become either recognised (non-ABS businesses) or licensed (ABS businesses), collectively termed 'authorisation'.

 

You must receive authorisation from the relevant authority before commencing your practice.

you cannot begin delivering regulated services until you have received authorisation.

 

If you are setting up a firm, one of the managers must be 'qualified to supervise'. If you are setting up as a sole practitioner then you must be 'qualified to supervise'. To be qualified to supervise you must have:

 

been entitled to practise as a lawyer for at least 36 months within the last 10 years

 

completed a 12 hour management skills training course

The Wright Hassel limited associated with Mr Patrick Foster isn't in Lemington Spa.

 

Perhaps it's just a coincidence with the names and Mr Foster, and his Wright Hassel LTD has nothing to do with anything legal related?

HI I'm disabled and parked in the car park across from Hillsborough precinct behind the shops, and today I've had a letter come through the post demanding £85 apparently I was there for 2 hours and 2 mins, I thought this was private land and therefore they cannot issue parking fines/ tickets. I find it very annoying because with being disabled it takes me some time to walk around.

Had anyone else had problems down there or is it just me? :help:

I have just received a notice to pay a parking fine which I dispute.the letter is from dcbl but it says this case is not subject to .high court or bailiff action.any advise please
