Private Parking Ticket Megathread (Part 2)

Now the Beavis Vs Parking eye thing has happened, how would I stand with an Excel PCN I have just received for parking behind the shops at Banner Cross. I arrived at 18:50, and the ticket was issued later.

Meanwhile I was in one of the shops who pay the landlord for the spaces, where I was assured that after 6:00 pm, the parking company would not issue any notices, so I didnt bother with a permit from the shop.

I have proof I was there in the premises, as I took photos of the events held there on my phone.

The people in the shop say there shouldnt be a problem as I can can phone their manager tomorrow and she would forward it on to the appropriate people.

After I caught wind of the Beavis and Parking eye court case the other day, I started worrying, although I havent read it yet - I find I get confused easily with things like that.

Have things changed enough because of this for me to be worried?

hi, i was sitting in my car in a pay & display car park waiting for a space, i was there for 23 minutes and had my engine running and didn't exit the car, after waiting i decided to leave the car park bearing in mind i was sitting in the car with the engine running and not waiting for anyone, 4 days later i had a parking charge notice for £100 by parking eye, there is a pic of me arriving and 1 pic of me departing, do i have to pay this as i have appealed this to parking eye and the appeal was unsuccessful, whats the difference between a parking charge notice and a penalty charge notice, any help with be really appreciated many thanks

Why were you sat in your car for 23 minutes? Couldn't you find anywhere to park?

no i went to 4 other car parks and they were all full thats why i decided to wait for a space

Did you insist on appealing via POPLA?

 

Did you admit to being the driver?

 

Parking notices are the private ones, Penalties are the council's.

i did say in the appeal that i was the driver and in the letter it says that if i appeal to POPLA and lose i will have to pay the full amount of £100 instead of the discounted fine of £60. people say dont pay and people say pay i didnt think you could get a fine if you were in the car with the engine running and waiting for a space

i paid money to appeal parking tickets for the fine i got on infirmary road...i have now recieved a bill from the parking company for £100!!!!!!

i have tried to mail them but its just an automated email i get back!

i cant email kirbylad either via here as says not recieving messages...any advise as ive paid parking appeals but now have a £100 bill which was £60 before i paid parking appeals!

Hi,

 

Has anyone any experience of dealing with a private parking company called Minster Baywatch?

 

I specifically interested in anyone who has received a parking charge notice whilst parked in the Casino car park they control at Queens Road, Sheffield.

 

I'm not after advice or the usual "ignore it" posts, but I am a consumer and I'm looking into the practices of the company.

Hi,

 

You've not actually parked, therefore in my opinion you didn't enter into any contract implied or otherwise and therefore do not owe any charges. It would be for the company to prove, albeit, only on the balance of probabilities, that you were info t parked and therefore agreed to the terms of the contract.

 

Don't worry about Beavis case, that evolves around the issues of genuine loss amounts to the parking company and what is deemed to be proportionate. The Supreme Court judges who are salaried at well over £150k a year didnt believe £85 is excessive surprisingly.
