New build house - brick choice?

It's a reservation fee, what happens if they can't get the funds to buy it? Will the builder pursue them in court?

No legal contract has been entered into and both parties can walk away at any point, I bought a house off plan that wasn't due to be built for 3 years and paid £200 reservation fee it didn't give me the right to dictate what bricks or other construction materials were used

 

The builder will just take the deposit . He has paid a deposit not just a reservation fee. This may be quite substantional. Builders are not in the habit of giving deposits back. // You are talking about buying a 2nd hand house already built a different matter. At one time estate agents used to ask for a 10 percent deposit to make it binding . Some may still do very crafty but buyers are more wise now

It might be more acceptable to planners to have of a range of colours;this would give a more organic feel to the development.You could always paint each brick after the building's erection.

We have put a small deposit down which will be fully refundable.

 

We just wondered if anyone has experience in buying a new build Properly and having the brick colour changed...it wouldnt be a change in brick type, just colour?! Why would this need planning Permission? Out of every 3 houses there is a red brick one all around the estate, is it worth contacting Rotherham council for their take on it all?

have you looked at the site plan? it should show a birds eye view of your property and the colour of brickwork,

also it may be that all the same house types are built in the same brick colour, i know its the case on most new build properties.

plans will have been submitted before the estate was built showing street scenes and materials to be used,

If you can get your money back whats your problem ./ Give over causing the builder grief if you dont want the house for any reason look for another one. You are a builders nightmare :loopy::loopy:

Yeah, it's all the OPs fault for lying to himself about what colour the brick was going to be. Poor builder is just being victimised by being asked to stick to what was promised.

To change the brick colour would require going back to planning. Brick colour is always stated on planning drawings as it has a huge impact on the appearance of a building.

 

However, it could probably be changed without too much drama on one house out of an estate of new houses but the planners may charge a fee to do so (this can be different in different areas). Someone is also going to have to make the change to drawings and communicate with the planners which is going to add to that cost. It certainly shouldn't require a whole new application so if it's important to you, keep pushing.

 

You could contact the planning department and ask them what their likely fee would be and what their initial thoughts on the change would be.

 

If you think the salesperson is bending the truth, you can check the planning drawings yourself - if it's a recent-ish application it will be online and if not, you can check them at the planning office.
