Bilge   34 #26 Posted February 18, 2013 How about banning all parking from Paradise Sq? It's a 'hidden gem' of the city centre and deserves much better than being merely a car park and a load of solicitors offices. It's not like we're well-off for locations like this in Sheffield so we need to make the most of what we have. The so-called Cathedral Quarter is hardly a visitor magnet yet. Bilge   34 #28 Posted February 18, 2013 although i agree with you, if it became a magnet for visitors, where would they all park?  A lot of them will arrive by public transport. Those in cars can park in one of the many car parks in the city centre. Others will park and ride on the tram/train/bus.
 Share this content via...
Eater Sundae   12 #29 Posted February 18, 2013 It's quite attractive, but hardly has a great deal of pulling power. I could not see that stopping parking would suddenly make it much more attractive to visitors. Also, the current parkers/leaseholders would need to be compensated for their loss of amenity. Who's going to pay for that?   I worked in the square at various times in the 70s, 80s and 90s. There were always occasional problems with people looking for free parking. On several occasions my Boss would go out of his way to block in anyone who parked in one of our company's spaces. He would then "disappear" for a few hours, and leave the parker to fume at being held up when they wanted to leave.
 Share this content via...
ECCOnoob   1,016 #30 Posted February 18, 2013 Big sign in the middle of it  UNAUTHORISED USERS WILL BE CHARGED  Really?  Even if the charges were enforceable, where is the signage which indicates the terms and conditions of parking?  Tut tut, you should know better. Feel free to park your cars there during the working day, folks.  Why dont you correct the landlords to their faux pas. Im sure they would delighted to hear from you about what they can and cant do on their own property.  http://www.sheffieldtowntrust.org.uk/
 Share this content via...

As already said, a bunch of law firms really should know better.  I think you've jumped on the "it's not enforceable" bandwagon, a little too quickly.  The tort of trespass is a very pleasant thing. Can be enforced by a landowner or anyone with a legimate and authorised interest in the land. Now we know that's not PPC's, but what if you are a lessee of the land, as most of the chambers and firms in Paradise are.  Well, then you have a right to sue for trespass.  We further know that in PPC cases, there's often no loss, as there are other parking spaces. Not in this case. Mr Barrister has a set space at chambers, and if he can't park in it (they have their own, if they're senior enough), he has to go off and park in town for a day, paying perhaps £15 for the day. Bearing in mind you've trespassed, he's under no obligation to shop around. Mitigation of loss doesn't always mean finding the cheapest, just being reasonable.  What else - how about loss of earnings whilst he messes around finding a space - an hour on QC wages is a good £500.  I don't work in those offices by the way, but I think you want to be careful assuming all private land parking can't be actionable.  Couple more things to add..  Firstly, you don't need terms and conditions for trespass. Secondly, whilst most places wouldn't try to enforce it, seeing as the barristers will often be at Court anyway, does it really cause them problems to represent themselves?  I agree with you moosey. this is not your usual ppc issue, like you say they will most likely have a land interest and could sue for trespass   Posted from Sheffieldforum.co.uk App for Android
 Share this content via...
gym_rat   10 #32 Posted February 18, 2013 Some people actually enjoy parking where they shouldn't in order to get into hassle with private parking companies. ?   though oddly going very quite when asked to prove they do? mentioning no names  @Penistone999
 Share this content via...

A civil matter. Intent isn't relevant.    Posted from Sheffieldforum.co.uk App for Android
 Share this content via...
Tallisman   10 #35 Posted February 18, 2013 But trespass cases never reach court unless intent can be proven. Thus trespass can be undertaken with complete impunity.
 Share this content via...
