Q: should every person arrested without charge be named in public and, if so, why?

 

I dont think anyone should be named until charged.

 

including high profile celebrities such as mention in Saville case.

It could even be argued that no-one charged should be identified (in public) unless/until convicted.

Not guilty otherwise, you see.

Thats a fair point.

 

Also it could be argued, why release a celebrities name questioned over a alleged assult over 20 years a go, but withold identity of someone questioned over a alleged Murder.

But hopefully on the Jury.

if by chance a forum member who had read or commented on this case was selected for jury service would they have to declare it before being sworn in.

I've served on a Jury before, the Judge would say to the Jury that the particular case has been well publicised in the media and social networking, and direct that the Jury find on envidence produced in court.

Juries don't sentence. They decide on guilt or innocence. They are also constrained by juducial guidelines and directed by the judge. The judge sentences if the jury finds the defendant(s) guilty.

 

Juries are not allowed to be influenced by outside factors such as the internet, intimidation, etc, but only by the evidence as presented in court. If they were found to have been influenced by outside factors a mis-trial would be declared. Other possibilities of wrong outcomes include an innocent person found guilty or a guilty person found innocent.

 

Sorry to tell you that an internet forum can't affect the outcome of a trial before anyone has even been charged but it's the job of a trial to establish guilt or innocence based on evidence presented to it by the prosecution and defence. Internet forums don't come into it unless you want a judicial system based on X Factor.

Police have now arrested 4 people in regards to this lovely man`s murder.

 

Rumours have been flying around facebook for a few weeks with names but to be honest, that`s all they are...rumours, although one name keeps popping up time and time again.

 

Whoever murdered Mr Alan Greaves needs to found, charged and sent to prison for a very long time. No doubt that it wont be long before this happens because the police are doing a fantastic job in high green, hats off to them.

The 4 people you mention include the original 2 released on bail.

The South Yorks Police keep saying second man arrested. So its the fourth really then isn't it.

But 2 of them released on bail. A bit confusing this. So might the other two get released on bail too if they cant find enough evidence against them.

Yes that is correct and rightly so until substantial evidence or enough to bring a charge.
