GodStar Posted July 16, 2012 Share Posted July 16, 2012 A friend has bought an old pub. Attached is a take-away business under separate ownership. The pubs water supply pipe runs through the adjacent property (not uncommon in older properties I understand). The owner of the adjacent property (by all accounts a nasty and unreasonable piece of work) has threatened to cut off their water supply if my friend doesnt do X. If the adjacent owner does cut off the supply, what steps should my friend take in the first instance to get the supply re-connected, and ensure this doesnt happen again?- police? water company? solicitor? Good- so there's probably an explicit or implicit covenant, on the part of the 'servient owner' [= person through whose land the easement runs] not to block or interfere with it. You could even enforce this covenant by proceedings; try to avoid these as being ruinously expensive. Instead consider a polite but firmly worded from your solicitor to the servient owner. Sourth yorkshire water have a duty of care to maintain a supply to your taps. If no water coming through taps they will supply bottled water. Its of their intrest to put seperate supply on. You could ask about a meter and they would put that in the pavement outside your propety. I think all new supplies have a meter anyway. The water main supply is already on to adjoing propety in causeway. . S. Y. W. Will put a stop tap and meter in front of his propety at there expence . If house holder has to dig a trench from stop tap to his propety probable cost £300 to £400 there are plenty of people out their with mini diggers and would take 3or 4 hours to dig depend ing length of dig He could phone a few people up and get an estimate. This is not a terrbile expesive job and fairly common in the building industry Cost of a mini digger with driver is £200 a day. Cost of a plumber to finalise conection £100. He aught ask lads who are working S y w how much they want to do work as they could be sub contractors . ANY thing is better than some idiot holding a gun to your head.
