Asked to work less than contracted hours?

Hi question for a friend:

 

She is employed to work 39 hours a week as in her contract.

 

She has been told today they are over staffed next week and said staff must take a days holiday or unpaid leave there for working under her contracted hours.

 

Doesn't sound right to me. Any one got any advise?

Be thankful of a job and take the day off.

The contract might include some form of wording that says the company can tell you when to take leave... I don't think they can force you to take unpaid leave, but I'm not up to date on employment law.

 

They could lay her off, in any event, and (again, unless the rules have changed lately) she would be entitled to no money for the first three days anyway.

I think she has to take it or leave it.

Best to contact her union rep and get them to sort it.

In the current state of affairs I would do as they say, and fight it when things get better next year.

Where I used to work it was always very very quiet over the Christmas / New Year week. Normally we where able to sort staffing levels out ourselves without anyone been told to take some holiday days, as a fair few wanted time off over Christmas anyway, but it did say in our contract that they could make us take X amount of days holiday per year ( I think it was a maximum of 5 days ) to suit the business needs.

 

I suspect the OP's friends has a contract with a similar clause in it.

Although she has a contract for a 39hr week I guess the employer might argue that this could be averaged out over the year ( Annualised hours ) …….. the idea of a unpaid holiday sounds wrong but with some form of notice I would have thought the place could shut up and force people to take holidays if there was no work.
