cv65user Posted December 12, 2011 Posted December 12, 2011 hi i have some ungated land people have used locally for parking. however an incident happened and some of responsibility onus is on me that i could have prevented the incident had i gated/monitored the land - this no win no fee insurers gone crazy! i cant monitor the land at 2am in morning. so i am going to chain the area but i now need a local sheffield clamper. could anyone recommend me?
waddy13 Posted December 12, 2011 Posted December 12, 2011 Stand by for the usual moronic replies to the effect that private parking fines/clamping is not enforceable so you are wasting your time etc. As a sensible reply why not try the company 99% of the forum hate namely EXCEL Parking on Cemetry Road
Cyclone Posted December 12, 2011 Posted December 12, 2011 How does clamping help you avoid responsibility for anything that happens to someone trespassing on your land. The chain I can understand, make it clear that they have no right to be there, but clamping?
Jim Hardie Posted December 12, 2011 Posted December 12, 2011 Why would you need a clamper if the land is going to be gated?
V.Rossi Posted December 12, 2011 Posted December 12, 2011 Fulfill your legal obligation by erecting a clear sign that anyone on your land is trespassing.
JoeS Posted December 12, 2011 Posted December 12, 2011 Fulfill your legal obligation by erecting a clear sign that anyone on your land is trespassing. And stick a disclaimer on it about "entering at own risk"
cv65user Posted December 12, 2011 Author Posted December 12, 2011 because last time i put some cones at the entrance with no parking sign as well as park at own risk , as well as clamping in enforcement signs . someone just moved the cones and the whole lot parked their still .
HeadingNorth Posted December 12, 2011 Posted December 12, 2011 How does clamping help you avoid responsibility for anything that happens to someone trespassing on your land. Anyone who gets clamped once is highly unlikely to park there again without permission. Within a short time, the problem eliminates itself.

I think you've missed the point. Clamping doesn't actually help to reduce any responsibility you have to keep the land safe, although I believe that such a responsibility is fairly limited when applied to trespassers anyway. A large ditch across the entrance would probably be more effective than cones though... Or a large number of tacks spread liberally about.

That's not your concern though is it? So long as you're not legally responsible for whatever happened... Maybe you're missing a business opportunity. 1) Hire someone on minimum wage to charge everyone who parks £3. 2) Profit.
