172-125 Posted November 16, 2011 Posted November 16, 2011 A very close friend of ours had an accident at the weekend & sadly lost his thumb while at work. He cannot claim compensation because it was simply an accident on his part & no one else was to blame. Does anyone know where he stands disability claim wise? What he needs to do & how he goes about doing it. He did work 3 different jobs, 1 was temporary till christmas so they have let him go with no pay. The other 2 are paying him sick pay. He is going to need another operation at some point & will be in plaster for at least 3 mths, then numerous physio will follow. Its his right thumb & he is right handed. I don't think he's realised what an impact this is going to have on his life. I'm going to get him some childrens handwriting books so he can learn to write with his left hand & some jigsaws because he said his left hand is useless. I feel so upset for him & just want to hug him every time I see him, but would love to help him in some other way, does anyone have any ideas?
Grandad.Malky Posted November 16, 2011 Posted November 16, 2011 I am sorry to hear that but don’t dismiss it as just an accident, I would imagine something as serious as that may need investigating by the factory inspectorate.

The manager was the one who took him to hospital & wrote it in the accident book, it's a restaurant kitchen he doesn't know what they do next

Grandad.Malky Posted November 16, 2011 Posted November 16, 2011 You friend needs some serious advice from a local solicitor, not one of these ambulance chasers you see on the adverts, perhaps a route around the HSE site might be a starting point. http://www.hse.gov.uk/pubns/cais18.pdf
172-125 Posted November 16, 2011 Author Posted November 16, 2011 He was washing the kitchen knives, he had the biggest one in his left hand, he put it in the water got the sponge & ran his hand across the blade, like you do, he saw the water go red, what he had done was when he had ran his hand across the blade he had actually trapped the sponge under his left thumb without realising. He's severed nerves, tendons & ligaments, and after 2 operations they cannot repair the damage. This is why he knows no one else was at fault it was sadly an accident
Grandad.Malky Posted November 16, 2011 Posted November 16, 2011 Sorry no he wrote the incident in the accident book If he is off for 3 days it becomes a “reportable” accident which sets things in motion beyond just filling in a accident book at work.

I'm just printing the link off you sent me thankyou, he was never told any of this, he could end up losing his other 2 jobs also with amount of time he's going to need off & the type of work he does
172-125 Posted November 16, 2011 Author Posted November 16, 2011 Thankyou Grandad.Malky He's contacting Irwin Mitchell at the moment for further advice, it's possible to get an appointment with a solicitor for an hour free
