In a nutshell i was forced out of my job, bullied by managment and im now on the sick. I cant do my new job due to my health at the moment and its having a detremental effect on mine and my families life.

I wrote to my former boss's telling them why i left mainly to get closure but they have decided to deal with it as a grievance so i need som info on what to expect and whats a realistic outcome from such a meeting.

As someone that deals with solicitors on a daily basis I would recommend Taylor and Emmet or Irwin Mitchell - both are very well renowned for their proffesionalism and have on other matters given honest straight up advice, whether it's the news you want to hear or not.

Your first point of call should be the Citizen Advice Bureau. All other options will be expensive and, if you are off work will illness already then, the last thing you want is the stress of legal bills.

 

I do not know your personal circumstance, but never let a work related issue stress you that much that it makes you ill.

 

My mother has a severe and rare type of dementia which is debilitating for her and my father. All I have to do is think about my mum and it puts all the issues I have to deal with into real perspective. You have one life; enjoy what you've got, rather than worry about what you haven't. I hope it works out for you.

Was it less than 3 mnths when you left your last job? You can't raise a grievance now you have left so you are not an employee as there is nothing to fix as such i.e. what solution could they offer you out of a grievance?

 

Are you hoping for a payout or your job back, or just a letter of apology you feel that way? They do not have to reply to you at all, nor have any meeting. I am guessing at best they will write and sympathise with the way you feel however they will then tell you that you never raised it to give them a chance to sort it out and now there is nothing they can do.

 

If you want a payout, then tribunal is the way, starting by filling in and submitting the ET1 form. Phone ACAS for help.

 

If the rules are still the same, you need to have left less than 3 months ago and were there more than a year, and have a very good reason why you never raised the grievance whilst you were still employed. You will also need to show enough reasonable proof of said bullying, etc and your very good reason for not raising it during employment, but only now. ie why now?

 

Consider what you actually want from them and consider if realistically, you are likely to get it. If you never gave them a chance to correct any problems, you are unlikely to have a successful claim. You can get a free half hour with an employment solicitor but if you lose, you will end up paying their very high costs which run into thousands.

 

Consider the bullying aspect; how bad was it? And how were you forced out of the job? You need specific answers - dates, situations, words used, etc. so think about how well you can recollect all the instances and how you can to a reasonable extent, satisfy to a tribunal that this really took place. It is not enough to say it just happened.
