The way BT are implementing it (as far as I'm aware) is that they will email a weblink to everyone where you can 'opt out'. This installs a cookie on your computer. However all your data still goes through Phorm servers, they just promise not to do anything will it (yeah right).  The major problem with this (apart from Phorm getting all your data regardless) is that if you clear your cookies ever you will automatically become 'Opted-in'.
