happyhippy   11 #25 Posted October 13, 2008 I receive lower rate care. I have fibromyalgia, but got the lower rate care for an indefinite period because of a disc injury and continued back pain. I get no mobility component. CAB filled in my form, but I wasnt impressed by this particular one and wouldnt go back to him. Recently I thought I would like to have another go. Apparently you can ask at any time to have your claim looked at again, or re apply, but if you already get something, you may lose that as your whole claim is looked at.  The most recent adviser I saw suggested I go and talk to my GP and see if she would support me ... unfortunately this is about number one hundred on my list of things to do! Anything to do with the children comes first.  Not quite. You can have a reconsideration at any point, but you can direct that reconsideration by saying something like "I do not dispute the original award to benefit, but now submit further evidence on the grounds that my condition has deteriorated.".  The important part is that you don't dispute the parts which are already awarded. She is normally very sympathetic, but I dont know if I caught her on an off day or what. I mentioned I was thinking of trying for the mobility component and she said I could try if I wanted but she doubted whether I would get anything. I took this to mean she wouldnt support me.  I also asked her if it would do any good if I saw a specialist about my fibro. She said, no you might as well stay with us for your fibro, nobody much likes seeing people with it.  If anyone is aware of a consultant who actually specialises in fibro please let me know because this has annoyed me somewhat. dollydoo   10 #28 Posted October 29, 2009 As anyone had trouble getting dla with fibromyalgia my mate seems to be having trouble getting it  is there any hints and tips to help him as he as asked them to reconsider  and can he keep on reapplying or is there a limit        .  Hi I also have chronic fibro myalgia and have been turned down 3 times for DLA, it's a minefield, I am going to appeal again, and have decided to join a FM support group in Rotherham, they meet on the 1st Saturday of every month and they have people there who can help with forms and will attend appeals with you, if you are still interested let me know and i will pass the address details onto you, i am waiting for them myself, but will have them in the next couple of days.  dollydoo Share this post Link to post Share on other sites Share this content via...

chabbychic   10 #34 Posted February 28, 2011 I suffer from FM and have been refused DLA, I have appealed the decision, and awaiting a date for the appeals tribunal, I could do with some advice regarding this, I filled in the application myself and dont think I did myself any favours, I have also had a GP sent by DLA visit me at my home on a day when I was feeling quite good for a change and assessed me on what she saw on that day, had it been the following day I wouldnt have been able to get out of bed to answer the door.......!! cjw064 Â Â 10 #35 Posted February 28, 2011 Hi the doctor was called an EMP, they are appointed by Atos Healthcare who are the appointed body for the DWP. As you are aware Fibromyalgia is a condition where no two days are the same, its just very unfortunate that the EMP came on a good day. Did the EMP turn up unannounced? If he/she did you have a good cause for an argument at any subsequent appeal... You did right to appeal but best to seek professional help for your hearing..
