Hi I am not sure if anyone will be able to help with my query, I have tried finding an answer online but finding it a bit of a struggle, I was advised by a friend that Sheffield Forum is very good for asking questions as there are a lot of knowledgeable people on here. Basically me and my partner have been together 5 years and because his wife wouldn't agree to a divorce at the the time I believe after 5 years he can now start proceedings. When he left the marital house was sold and he gave her a large lump sum and took all the debt which has now been paid off. This was all done without a solicitor, she accepted the money and that was that although we have proof that she was given the money which however was a lot more than half the collateral that was in the property. We have no idea where she is living at the moment but know she has changed her name by deed poll back to her maiden name. Since we have been together we have bought a property in joint names and there is quite a substantial amount of collateral in the property, My question is, when the divorce proceedings start and she is back on the scene (if we can trace her) would she be able to make a claim for money from our property as technically they are still married. Thank you for reading and any advise would be welcome.
