The concept of occupier changes in group vs single occupation although that said you can sue a landlord for actions of a tenant (eg noise) if the landlord knows about it and does nothing. Another example. Tenant damages property creating hazard. Landlord with maintenance duties knows but does nothing. He can be sued. A lot of it relates to the landlords knowledge and permission.
  4. Very doubtful this is true. Google "Ex Turpi defence" and you'll see why. Basically, you can't sue if the cause of your injuries is your illegal act. As with all claims, the person could of course sue - the question as to whether they'd win is an entirely different question. I suspect not from experience. It wouldn't be a private prosecution, but a civil claim, but as above, subject to any random judicial decisions (which always exist) I think urban legend is quite right. Technically not - "assault" as such is a criminal offence, in that it's the immediate threat of violence. The tort, that can be sued for, is battery, and you can certainly sue for that. I've done it a number of times for clients. There's a lot of confusion between criminal and civil law. Self defence - you can use reasonable force. If you don't, (if you bring a gun to a knife fight to use the quote) then you leave yourself open to criminal action - Tony Martin, Lee Clegg etc. If someone is trying to kill you, destroy or steal from your property, you can defend yourself with reasonable force. As above, they could try to sue you (civil claim), but it's likely to fail due to ex turpi in my view. Not saying that some claims won't settle or even succeed due to random Judicial decisions, but in theory, they certainly shouldn't.

  10. Dont be so bloody selfish. Clearly you dont work in town then? I do and cant afford to pay the ridiculous parking charges. One of my colleagues is forced to pay £7 per day parking. Thats £140 a month. Can you afford to give that out of your salary? I cant. She lives in Chesterfield so has to drive. If you put meters on every road within 2 miles of town, you alienate all those who want to drive to work. Why shouldnt I drive? I pay for my car. Im not some joyriding, scrounging little **** who doesnt pay for tax, insurance etc. The fact remains that public transport for me is not a viable option, given the equipment I frequently travel with in my car. Also considering the high price of public transport, its just not something Im prepared to use. Why shouldnt I rely on the cheaper option, use my car, and park on a side road for nothing.
  11. The reason people use the side roads in Hillsborough is because of the following. 1. Parking in town is impossible, or stupidly expensive. I admit I used to park on the side roads in Hillsborough before I discovered the area I park in now, which is far closer to town and within walking distance. If there were better parking facilities in town, people would be able to take their cars all the way. And before anyone starts the "you should use public transport" argument, buses cost £3 per day, each, for my wife and I. That would be £30 a week, or £120 a month. I cant afford that. Besides, buses to Deepcar are hopeless. 2. The park and ride is about £3 also. If it was free, as the one at Centertainment is, people would use it. People dont mind paying for the tram fare, its the additional cost of parking thats annoying them. If there is a perfectly good, albeit irritating to residents, but still perfectly good free option, why would anyone choose to pay? No one in their right mind would choose to pay when they dont have to surely?
  12. Dont know whether its what youre looking for, but we got married at the Marriot in Nether Edge and couldnt fault it at all. Everything was absolutely amazing, and the food was simply unbeatable.
  13. How many people who are complaining about people going through the gates speed in their cars? I bet it's a high percentage. You can't whinge about people breaking one law and then break another yourself. It's called hypocrisy. Incidentally, those concerned will be interested to know that the penalty for failing to obey a road sign such as this, a bus lane or similar is not points, it's a £30 fine, although the actual amount may vary. It's not an endorseable offence though.
