Topic.

On the 23rd of December last year, I bought and paid for by Paypal, a "faulty" 16 Gig Ipod Touch on eBay, I allowed the seller a week to dispatch and deliver the item to my Parents' address (as I was residing up there over the Holiday period), he has since contacted me telling me he's "moved house" and "forgot" to post it!

Anyway I threatened to open a dispute on him so he said he'd post it this week, and he has done so by normal first class post, told me it would be here by today, no post has come to my Parents.. I've looked on eBay to see if I can open a dispute against him, and they said if it hasn't arrived by Friday to contact them again.

Is there anything I can do? On one hand I'm unhappy this has been going on since before Christmas, but on the other hand I don't want to spoil my 100% positive feedback by appearing to be pestering him.

As for the "faulty" Ipod, my research online and in the local Apple store tells me I can get it repaired for half the price of the item, I paid £29 in total inc postage.

If ebay said you need to wait until Friday to see if it arrives, and then contact them again if doesn't. Then I think then that your only option is to until Friday to see if it arrives, and if doesn't contact them again.

A seller can not give negative feedback to a buyer,so your 100% f/b is safe.
Have you checked the sellers feedback? Do they have a good %? If so,it could be a genuine mistake,if it's crap,leave them -f/b...............they deserve it!!
I have a 471 f/b score and 100%,there is no need for p155 taking unless it's genuine.

corsaman is right - sellers can no longer leave negative feedback for buyers so you don't have to worry about that.

It would have been easier for you if he had posted it recorded - it only costs a few pence more for the seller and you could both track when it had arrived.

It sounds like the seller is messing about, maybe expected to get more for it and might not have posted it at all. email him again and see if he really has posted it - if not, you might be better off just getting him to cancel the sale and refund you.

The non - feedback for buyers is a real pain, I've had no end of buyers shafting me.

Don't sell on flea-bay then.
Why should I do that, I made over 15k on there last year. Just because there are some exploiters around, I wont be deterred by a bunch of pillocks. By 'no end' I mean they will always be there, but they are by no means my sole trade.

It turned up today, thing is, I took it to the Apple shop in Meadowhall to see about a repair, they want £106! WTF?! The eBay guy quoted me £25 for the repair! The assistant said it would work out "more cost effective" for me to trade the old Ipod Touch in for 10% off a new one, which would then cost me £152... I rang Dad at work to get "permission" to spend that kind of money as I'm on benefits, and he says "we'll talk about it", in other words both he and Mum will say no.

So either way I've been had, I will never buy anything on eBay again! And dumb ass seller in kent can kiss my arse, I'm sending his "broken" Ipod back for a refund.

Seems you might have a little to learn about people/ebay.

If the item description on ebay quoted an estimated repair you have a case because the item is not as described. What you could do is get in touch with the seller asking for a refund. If he refuses, which he probably will, THEN raise an ebay case. If you paid paypal you have protection. Also check the bottom of his sale page and see weather he's said he takes Returns in the first place.

Ebay isn't such a crap place as long as you're careful buddy.

I've been in touch with the seller, and he won't do a refund... So like I said, he can kiss my arse and I'll launch a case against him on eBay for selling me something not fit for purpose.

I would be very surprised if the seller offers a refund / return, I'm yet to see an item on eBay described as "faulty" which doesn't also have "As this item is faulty, no requests for refund or return will be accepted" (or the like) also as part of the item description.

Can you post the link to the item?

The issue is, it was described as a £25 fix and it's around £100. Not as described.
Distance buying policy should be in favour of the buyer.
Hmm to save further angst just write it off to a bad experience that'll hopefully result in more scepticism next time.

According to him, the £25 was from a local repair shop, not an official Apple store.

I even went in Curry's PC World at Meadowhall to see if it would be any cheaper to get it fixed by them, they don't repair them

I wouldn't mind but I have about £50 worth of Itunes content on my PC from when I had an Iphone last year that I can't do anything with as it's not compatible with any other device but an Iphone/pad/pod.

Actually yeah I could, the assistant in the Apple shop said it wasn't a 1st Gen Ipod as advertised, so technically he's broken the trades descriptions Act by saying it was one.

Might be a lot cheaper to try Fone Fun Shop near ASDA Handsworth for a free quote.

Yeah, I'll nip down there next week and see.

Thinking though, if I took it to somewhere like Maplins at Hillsborough would they be able to do anything? It's a bit more local than Handsworth you see.
