I'm going to the 12 oclock court this week to appeal against my not being allowed incapacity benefit,
happyhippy has been very good and offered me advise, and it is much appreciated thankyou very much
just wondered if anybody elase has anything to tell me about it.
has anybody been recently,
Dont know why I'm nervous think its the word court.

As was said in the other post, "Court" is only the name of the place, like "Avenue", or "Close", or "Mews". (it's like calling the place " 12 o'clock close" :- it was named after an old building that was there fifty odd years ago, that is all it's just unfortunate)

Have you got someone to support you? eg someone from the CAB or other service to represent and advise you? It's really a good idea to have someone to represent/ support/ advise you in a situation like this.

I went in December. It isn't as bad as it seems. The people i saw were polite and not intimidating. I went on my own on behalf of my son who has autism and the appeal was upheld in our favour. I was interviewed for about 20 minutes, then i had to sit back in the waiting area for the decision and i was presented with a statement with the decision on when i went back in. The problem i have had is that the DLA are dragging their feet on paying the backpay. They sent me a letter saying that they were waiting for a statement from the appeal showing why it was in my favour and they might appeal against the appeal- something i was not aware of. So far i have been waiting just over 4 weeks albeit with christmas in the middle so i am just hoping it all works out- i have rung up and the latest i have heard is that i should know a decision by early February- i pointed out that the sooner it was sorted the better it would be for my son- we were granted high/high and i would like a mobility badge to make his life easier which is something you simply cannot back date.

I'm back from the appeal court, must admit I was really nervous,
but it wasn't as bad as i expected,
there were three people in the room, but I was very well represented, and supported.

It was just a relief to know I was believed this time,
as I'm sure the other Doctor who did my examination and I use the term loosley
Obviously just didn't listen to me as his answers were nothing like the ones I gave

I was asked the same questions again today and answered them as honestly as I know how relating to my condition, and my appeal was successful.


So thankyou to evryone who offered help especially happyhippy and plain talker
much appreciated.

Thanks I hadn't realised I got a backdated cheque
but haven't had any thing since July so thats a nice surprise

you should (theoretically) be paid what they owe you from the time they originally turned you down, (if you have been "paid-short", that is, eg for any DLA or whatever, they denied you if that's part of what you had claimed)

glad to hear it's good news, and that you won your appeal.

What ^^she^^ said.

The decision of the tribunal should be effective from the date that the earlier doctor said you weren't entitled. So, as the evidence was from that date, and had been overturned, you should get a nice cheque back, dating from the last date for which you were paid.

For you, it's especially important as it's Contributions Based IB, and therefore not means tested.
