Accident involving disabled facilities

A friend of mine who's disabled used the disabled toilet at work a few days ago. As she was using the lift bar to transfer herself from the loo to her wheelchair, the lift bar came clean off the wall, causing my friend to collapse in a heap. She's bruised a large portion of her left ribs and is in pain.

 

She's going to the docs but I want to know what action she should take. Clearly the bar was not fitted correctly. My friend isn't a large person and those bars are designed to hold twice her weight.

 

Its been four days and the damage to the facility hasn't been repaired so at the moment she has to be escorted to the loo which is highly embarrassing for her.

 

Just looking for advice

Has the accident been logged by anyone ? were pictures of the faulty bar taken ? Phone Claims Direct or similar and let them deal with it :thumbsup:

If you are refering to compo, I dont think that there will be much from just pain and bruising, an accident at work should be reported thru the proper channels. The employer will need a reasonable ammount of time to fix the toilet. Make sure the right department knows its important.

Incident has been logged however she had to ask her line manager 3 times before it got recorded.

 

Photos of the bar and the mountings were taken at the time of the incident., as have the resulting bruising. Doc has recommended time off work to heal.

I would have thought negligence would be a big thing in this case. Failure to install disability aid equipment correctly.

You can only get damages for what actually happened, so negligence or otherwise, severe bruising won't get her a lot of money. It will however p*ss off her employer, something to think about. But might also focus their minds and make sure they don't do things badly in the future.
