Private road ownership

Does anyone know what the legal situation is in the following scenario please?

 

I have a field at the side of which runs a private road. The road doesn't provide access to my house, but does so to circa 12 + other houses. I can't find details of who owns it, and my deeds don't mention it. My question is this:

 

Am I legally judged to own the road that runs along my frontage i.e my field (to an extent of 50% of the roads width, assuming land owners on the opposite side own the other 50%)

 

If so what are my legal obligations and rights regarding this.

I've no idea of the answer I'm afraid but would suggest you speak to a surveyor or solicitor. Happy to introduce you to the chap we use for this type of thing

As far as I can see there are two possible scenarios.

1. You don't own any of it. The land was sold to the owners of the houses and therefore doesn't appear on your deeds.

2. Access was granted informally and therefore not detailed in the deeds as an easement. I would think it unlikely that anyone would buy a house without a legal right of access.

Start by making an HMLR Index Map search form SIM, as a hard copy with a copy plan showing the road edged red. This will reveal who- if anyone- is its registered proprietor.
