Just getting back to the concerns of the OP and your suggestion that the best way to protect a company name for a sole trader is to get a trademark for the name...

 

... would I be right in thinking that if the OP just forgets about it and carries on with business as normal, then there is always the worrying possibility that the 'copycat' business owner could in fact apply for the trademark themselves and so stop the OP from using the name, even though the OP may have been trading under that name for several years? :suspect:

No, in that hypothesis, though yes someone could apply for the mark 'later', the OP would have what is called an 'earlier right', and could actually oppose that later application for registration. Depends how widespread that earlier trading would be, though (it would need to be more than just local). These are just the general principles, your mileage will vary with every case :)

I think it's a shame that people who are prepared to share their genuine knowledge and experience freely on here for the benefit of others are now being made to feel that they are no more appreciated than any Tom, Dick or Troll who happens to be best mates with Mr Google.

 

I have always found your posts very interesting and informative.
