View Full Version : Hit a pot hole and damged my tyre , need advise
hi ive hit a massive pothole in dec in dronfield ive rung the council up and they said get 2 quotes and a picture of my tyre and the pot hole , the day after i reported it i took the pic but they had filled it , the thing has split my tyre right round , ive only just got a reply back saying because the pot hole was never reported before i hit it so they cant offer me any comp , my dad said the pothole was there 2 weeks , now ive got a £150 tyre bill that i cant afford , ill have to go 2nd hand:(
Yep - the council will rely on what's known as their Section 58 defence (basically Section58 of the Highways Act).
If they inspect the road fairly regularly (we're talking once every 6-12 months), and nothing was seen on the last inspection, you're onto a loser. Two weeks is nothing in the scheme of things I'm afraid.

What do you drive? A Porsche? You should have bought a cheaper tyre!
As said above, you have little chance of getting any money out of them unless you can prove the hole was there for ages.

I bet dear old Dad saw it and did nowt-if he saw it perhaps he could have lifted the phone and made contact?

AJ sheffield 14-03-2012, 21:40 I got £70 back towards a tyre after hitting a pothole. I put it towards the £120 it cost for the new tyre and thought I didnt do too bad out of it all until about two weeks later when I found out it bent the radius arm, drop link and tie rod.
Just try and price a continental 235 45 17 up and you will find you won't get change out of 100 ,then there's the tracking, a good tyre saves lives, what do u buy, remolds?What do you drive? A Porsche? You should have bought a cheaper tyre!

Mine are 225 45 17 and I get part worns for 25quid! Got a nice Goodyear the other week, almost new!

Assuming all four tyres were of a certain quality, costing around £150 each, why would they choose to fit a cheapo tyre that won't perform on par with the other three tyres? :huh:

Assuming it could have been missed at the time. Did you witness it? Do you know for certain it was possible to avoid?

However, considering I didn't know I had picked a nail (on Brightside Lane, terrible for this with all the tip artics driving up/down all day), and that it caused my (near-new, 1 month-old, premium) tyre to burst 20 mins later in the middle of 17:00 rush hour traffic on the M1 (doing 70 to 80 at the time), you have to wonder what the chain of liability would have been (ending with the Council?) if it had caused a massive pile-up/injuries/deaths etc.
It's not exactly easy/straightforward to drive a RWD car at 70 mph in a bend with a burst rear tyre on the outside, in the middle of close-in fast-moving traffic, to bring it from the outside lane to a safe stop in the safety lane ;)

If, through negligence, the council causes damage or harm where they have a clear duty of care then yes, the affected party should be compensated.

I get mine from Burngreave MOT centre. You might have to hunt for the extra weight ones. In fact I take everyones cars there for MOT's and work as they are really good. Mine is a Saab so it Goes to Paul Smith, but if it was anything else it would go to the Burngreave garage.

i suspect 90% of folks claiming they damaged tyres or wheels in pot holes actually hit curbs or went off the road. They then spend hours driving round looking for a pot hole to blame it on.

Not in this case.
Car Drivers pay their road tax and the state of the roads in Sheffield and the surrounding area is awful. Also when your driving its hazardous to start swerving around avoiding the stupid amount of potholes Sheffield has.
The council wouldn't have to pay out all these random claims if they did their job and repaired the roads properly. Rather than allowing electrical and water firms to bodge the roads up when they dig them up.

Maybe it was a night? Maybe to avoid the pot hole could have led to an accident? Maybe the pothole was full of water and didn't look very deep? Maybe the pot hole was round a blend bend? Maybe the driver was focusing of the road ahead rather than two feet in front of his car. Maybe the roads should be in a good enough condition such that you can travel down them with out causing any damage to your car (with the caveat that you are within the speed limit as this is deemed the maximum safe speed for the road)?
Maybe the wear and tear on cars in Sheffield caused by the poor road conditions is greater than in other cities in the UK?
Maybe your post was jam packed of ill informed drivel?

The state of the roads needs looking at regardless of little or big the potholes are. A big pot hole will get poorly repaired and in the mean time a smaller pot hole gets larger with wear and tear on the roads.
Japan after a tsunami can repair its roads within a week and Sheffield after a flood still hasn't repaired its roads 5 years on.

At some point the pothole would have been more than 2 feet in front of the driver..why didn't he see it then?..in your hypothetical case of course.. :) I agree the roads should be in better condition but how often do you expect the council to check them? If the OP's father had told them about the hole when he saw it maybe something would have been done about it..

I don't know, I sure you can come up with a number of valid reasons why a pot hole might not be seen until it is too late to avoid.

Nope, I just put forward alternatives to how the damage occurred. I have not slated the OP in any way and patiently wait for him to respond to my alternatives to clarify the situation.

How fast were you going?
All high speed roads are sound, they are patroled by the police and other agencies who report bad defects.
Are you sure it wasnt the kerb you hit?
Just a suggestion, but in the dark it is possible.
