View Full Version : If a wheelie bin hit your car?
Last Friday was very windy and it was wheelie bin day in Crookes. It set me wondering, as there were a few blowing around after being emptied, as to who would be liable to pay the costs for repairing a car that was damaged by one.
Would it be the council? Onyx? the bin owner? or the car owner?
Interesting question i think.

Yeah I think it was a Billy Connelly film.
Just before Christmas I hit a deer which damaged the front of my car, I couldn't claim on the insurance as it was an "act of god".

Slightly off topic but I nearly got decapitated by a flying bread crate on Page Hall the other day - that was fun :)

I've seen loose bins making their way down our street at top speed on a windy day before now. Looks hysterical - unless it's heading straight for you:P

I leave my bin on the street on my way into work. The binmen come, in my absence, and empty it.
I am not home to put it back in it's place as soon as it has been emptied.
If, during my time at work, the wind blows my bin into a nearby car, should I be responsible?

But plenty of people just randomly leave their bins lying about all week, which in windy weather causes chaos. I have images of calling out the cowboys to get out there and lasso them all up, lol.
Maybe we should all get half-days on bin days so we can go home and tend to our bins:D

jackthedog 22-03-2004, 14:03 Perhaps we could blame the council, for not returning our bins back to the gardens. Perhaps we could argue that they dont provide us with enough 'wind protection measures'.
Perhaps the manufacturers of the bins could be held responsible for not designing a suitably stable, aerodynamic bin.
Perhaps we should lobby for padding to be applied to the corners of all current bins in case of any wind related misfortune.
Perhaps in future, new cars could be fitted with scuff plates in the areas where bins might bang into them.
Are car manufacturers currently doing enough to protect their customers from the misfortune that may occur in the event of wind on bin day? Are they being lethargic and simply putting profits before customer welfare?
Come on, surely there's gotta be more people we could sue. Any ideas anyone?

I was just musing on the question of who is responsible for the wild hordes of wheelie bins roaming the streets. Personally I keep mine tethered in the garden except on Tuesdays when - as you so correctly pointed out - it runs wild and free until someone gets home and wrangles it back into the garden.
So keep your hat on (if the wind will let you:D )

side note: can you claim if you're agnostic/atheist?
i would say it would be onyx or the council fault because due to the process of illimination
it cant be the car owners fault becuase how do they know it is going to be hit
it cant be the biin owners fault because if your at work it has nothing to do with you and is under no control of yours.
and possibly not the council fault because they only provide the bin not put them on the street
and onyx is the only one left, plus it is their employees that place the bins where they can get blown over!:loopy:
