If things go to court it will probably be a lot less if anything because theNHS/BMA and the legal system work hand in glove with each other and by that stage couldnt give a fig about providing either health care or justice respectively. What then tends to happen is they and the lawyers hold hands and work out the most effective way to gloss over all the key facts and turn events around in such a manner as to be truly unrecognisable to the aggrieved and injured party(ies). If you've achieved this without a solicitor you've done extremely well indeed and I'd be reluctant to suggest involving them; before you know it they'll want to see papers, drag things out, make a lot of work for nothing and cause you substantial stress and distress when all you want is to wrap things up swiftly. I think there is something called the White Book which I think lists things like damages which may be able to give you an idea of reasonable entitlements. You could also try searching for similar cases to give an indication of what could be a realistic settlement. Whatever offer is on the table I am quite sure it will definitely not be adequate. If it is the first settlement offer I would think they are trying it on and hoping to get away with it.
