Hi all, here goes with our story, the short version, we live in a flat around chesterfield, on the top floor of a 2 story and our neighbors underneath us are constantly smoking weed.

We have a 4 month old baby girl who we had 2 take 2 hospital tonight as she was STONED out of her tree!!! Her eyes where red raw, like saucepans and generally very ill, sick and crying. The smell just comes straight up to our flat.

We are currently in rykneld homes housing and we are clear with all our rent but we do owe some water rates and house insurance.

We need to move asap as nothing is ever done about the people below us but rykneld homes will not put us back on the housing list!!!

I have been informed by CAB that if i rent is clear they should put us back on bidding list but they wont!!!!

AAAAGGGHHHHHHHHH!!!!!!!!!!!!

What i have done so far is contact Rykneld homes and explain the situation and the hospital visits but they wont put us on because of water rates and insurance!!

Contacted my local MP, no reply yet!!!

Threatened them with going to the papers!!


Does any1 know what we can do???????????

Or offer us anywhere to rent????????

We are good with money and can provide refs but cant really afford a bond so i know its a big ask!!

Please!!!! We do not want another trip to the hospital with our little angel!!!

Oh and we cant stop with family as i do not have any family left and my partners family live in brum!!

first thing i would do is ring the police, how much do you owe would it be possible to pay it off

i didnt think they could stop you going bk on the housing list only stop you moving for any kind of debt.

i would try the police again and explain the situation or try 101 as then it gets logged with the council too

does 101 cover chesterfield, i know it does sheffield?

I thought councils and housing associations were slapping control orders of some description on people like this

you'd have thought that the police would be compelled to act when this is how far it's gone wrt your baby. have you tried contacting the neighbourhood police directly?

Have you tried joining them and forgetting about all your problems???

on directgov it says 101 is wales, london and sheffield only and as for police i have tried everything, they came once but havnt since, that was about 6 weeks ago!!!

surely the situation has now escalated to more than 'irritation'?

getting a baby stoned is pretty serious stuff

the system is stupid if you got your own baby stoned you would be reported to ss, yet if a stranger is getting your child stoned thats allowed.

Hold on a mniute...If theres proof the baby was stoned and a strong smell of weed then something must have been done??

I thought water rates were charged for the whole block of flats rather than an individual flat. On a private block part of the service charge normally covers the water rates, ditto insurance.
You may be able to find assistance in obtaning a bond for renting a private flat.
Can your partners family help out with the bond?
What about friends?

Did the hospital say the baby was stoned ?it would take a hell of a lot of weed to be smoked to permeate a flat above to cause that reaction..theres a lot of colds going around...or is it just an excuse to get out of the property

Yep, the hospital said exactly that and would a cold cause wide pupils and the whites of her eyes to go dark red so u cant see the whites, i dont think so. And i can tell you now that they are smoking it every hour of every day.

if thats the case the Police or/and social services have got to act..the hospital would act on it as a priority

and we have been told that the water rates are nothing to do with the rent, we are clear on rent so they should put us back on!! but they wont!!!you are right ,water rates come from the regional water supplier ,write and explain to them why you want a move come to an agreement on how much you can pay each week/month off your debt ,if you come to an agreement ask them to confirm by letter ,take the letter to the council and ask for a photocopy to be kept by them

the housing act states that you are allowed to enjoy the home you live in, so the weed smokers are not letting you do that ,phone the c a b and check ,they will then, if asked ,write to the council pointing out the tennancy agreement has been broken by the dope heads ,this should force the council into action

you should also speak to your health visitor who SHOULD be able to push things along for you in the same fashion as if the walls of your flat are damp

Funny that, we had council champions round yesterday along with police and a police dog and social services, they could all smell it and the people below us have till end of next week to move out along with the police pressing charges, they where also dealing from there and have took some of our little girls clothes with them for evidence along with medical report!!!

If you took your baby to hospital and they actually said she was stoned, they would have called social services themselves, there and then. They wouldn't know if it was you getting her stoned and so wouldn't be able to let her home with you without investigation.

And like i said in my previous post, investigation has been done by social services as the doctors at scarsdale did contact them, as well as recommending us to do so which we did, although it was hard to get through to them at 1 in the morning but we got their in the end and they informed police and it has now been resolved and WE weren't the culprits and wouldn't ever dream of doing that to any child, never mind our own.

And what with all the bad press social services have had recently what with the baby p case, they needed to pull their finger out and did, i take my hat off to them.

But in such a case, like if a baby was admitted drunk, they wouldn't let them home without checks for safety. They did it when my daughter had an asthma attack and she only had very mild passive smoking symptoms.

Good luck with your new home Mattoo I hope you get something soon. It sounds to me like your existing home is unfit for human habitation. I find it shocking that people have to live in such substandard multi-occupancy buildings in this day and age. Your landlord/housing association should be ashamed of himself/themselves I wish there were much stricter laws to protect against this sort of thing as there are with newbuild accommodation.

this is my last post on here as im moving monday so i will say how i feel
there are some people on here who have no feelings for anyone but themselves,as life goes around the same thing may happen to them that has happened to posters on here ,i hope it does then they will realise theres a world out there that doesnt revolve around selfishness

phone the police everyday, keep a note of the incident number. every month if nothing has been done, make an official complaint. keep doing this.

You are correct - It is impossible... You cannot be stoned from a smell... Only possible if the baby was in the room with the smoke, and what are the chances of a large volume of smoke entering the OPs flat? Short of huge gaps in the floor, and the people downstairs burning loads of weed (unlikely) then the smoke would not be in the OPs flat...

I agree, although it may stink it isn't really possible for your daughter to be stoned from the description you have given, but the police should definitely help

Why are some people accusing OP of lying, clearly as police have been involved then her allegations have been substantiated. As for them not feeling effects, adults build up immunity that a four month old would not yet have

Surely the hospital could do a test to see if your baby was indeed affected,obviously you would not want to put them through the trauma of a blood test but i believe it can be detected in a hair sample,that would prove whether your child was affected and then surely the police could act.
I suppose though they would have to prove it was your neighbours and not yourself that was smoking it.
