Even Bond had one where the bad guys sort of won (well, at least got revenge) - On Her Majesty's Secret Service (they killed his wife)

I suppose you could also say that in most of the 'slasher' movies the bad guy wins, as he is always alive (of a sort) at the end. For examples see Nightmare On Elm Street series, Halloween series, Saw series, Friday 13th series, Texas Chainsaw series etc etc

When you look at the lives that the high ranking Germans who lived had after the war, and compare this to how the people from 'band of brothers' fared; the bad guys from that film won.

Skeleton Key with Kate Hudson. Not a great film for the most part but I really liked the ending.

there's a german film that i cant recall the name of, basically 2 young men take a family hostage and terrorise them (alot) which leads to murder and they get away with it, its an amazing film, even if only by the way they change the outcome, genius film, if someone can name it i'd be very gratefull.

Well, he wasnt shot by someone accidentally whilst they were out clay pigeon shooting.

Film clearly infers it was a deliberate hit by a paid assassin.
Then credits soon roll.

The MPAA (US equivalent to the BBFC) had a rule that has only recently been recinded. It said that "No person committing an illegal/immoral act can be perceived to have gained, either financially or morally, from their actions". Therefore until fairly recently if a baddie was to get away with it they had to perform an act of such utter selflessness as to render the previous misdemeanors obsolete.
