firthandy 02-11-2005, 12:37 A friend started a job at the beginging of Sep 05. She left the position at the end of October 2005. She was paid for the 2 weeks work i had done 01/09/05- 15/09/05 and 2 weeks holiday pay 15/09/05 - 30/09/05 (holiday pay which i shouldnt have got as i never went back to work with them after my holiday)
So they should have asked for some of that back but never did.
She has just checked her bank and has been paid a full months wage for october 2005, though she never did any work for them.
Question is
Can she spend the money
What should she do
Can the request the money back

Then go and splurge in the winter sales :clap:

Personally I would put it in a seperate account and wait a while!!

AtticusFinch 02-11-2005, 12:58 For me it would depend on who the employer was. If it was any kind of state employer I'd give it back, as you'd be taking taxpayers' money. If it was a private company I wouldn't have many scruples about keeping it though. :P
Like someone else said though, I'd recommend waiting a month to see if they notice and take the money back from you.

Its a retail company who do very well out of selling overpriced goods.

hachandhach 02-11-2005, 13:15 that happened to me an employer kept paying me and id been left there 2 months, as i wasnt working i never went to my bank (no overdraft then ) so it stayed there, when i went to my back i was shocked asked the bank who put it in thinking it was my dad and he forgot to tell me and it turned out to be my previous employer they did that 2 months on the trot but then just stoppped , i was told due to there mistake them paying me i didnt have to give it back but i bet the law has changed, i never gave it back as they didnt ask, went on a mad spreeeeeeeeeeeee

DragonofAna 02-11-2005, 15:21 Not sure if the bank will allow someone unauthorised to draw money out of an account. The place where I used to work tried to get money back that had been overpaid to previous employers and I am not sure what the outcome was.
I would leave the money in the bank for a very short time and then go spend it (actually I would not know if I was over or underpaid). If it is gone - how they going to get it back. This may not be very honest, but it is christmas ;)

But as she no longer works there its not like they can take it off her in her next pay packet

In that case definately inform them of their mistake otherwise if you spend it you will end up paying it back to them in instalments.
I know someone this has happened to, they spent it then had to pay it all back

through the courts.
Hang on for a while, put it in a savings account or something. That way you can give it back if you have too.
In a few months (maybe 6, companies can be quite slow) then spend it.
apart from the moral aspect of keeping the money, will your friend pay it back if asked?
If it's been spent and that's used as an excuse not to repay will the firm give him/her a reference for another job?
If taken to court how good will it be for their credit rating?
Is it worth it?
