if you apply for a job, get all the way to getting it then get told you cant have it because you cant drive, is this discrimination or not?
This was not mentioned in the advert or application as its not a requireent for the job itslef!
I think this sucks!
I don't know if that post and your signature are connected, but I've just got visions of a roofer trying to get all their gear and materials to site on the bus :hihi:

not if being able to drive is in anyway part of the job.
If it's not a requirement then it's certainly unfair...

My last boss wasn't a driver but went for a job where she had to travel all over south yorksire and Derbyshire. The company had put on the form that being a driver was a requirement for the job, my boss just didn't write anything on the form about being a driver or not and they didnt notice.
When she was offered the job she owned up and was able to negotiate with them. They agreed a travel allowance which she could use on public transport (any cost above that would be covered by her) and she agreed to take driving lessons - no agreement that she would actually pass her test.
She did in the end pass her test but not untill she had moved on to another job.

If there was nothing in the advert; job description, person specification etc. to say being a driver was a requirement of the job then it is discriminating. What's their policy on disability? If someone with a disability applied would they be prevented from getting the job? Employers have an obligation to look at exploring alternative arrangements in such situations. I think you've been conned (but do you really want to work for such an employer?)
There is no legislation to prevent discrimination on the grounds of ability/inability to drive. So if their reason for not giving you the job is genuine, they have done nothing wrong - legally.
However, if it wasn't mentioned in the vacancy ad', person spec or any other information supplied about the job, then it seems rather strange that they have used it as an excuse.
If there are other reasons why you think they may not have given you the job which would break employment law (race, sex disability etc) but have used the 'not being able to drive' as an excuse you may have a case. The case would obviously be strengthened by the fact that being able to drive was not a specification or requirement of the job.
