Right my mum has a 3 bed council house, there was me my brother and sister living there but now me and my brother have moved out into private rent my mum is thinking about moving to a 2 bed house, but i really dont want her to give up the home i was born into and spent my first 20 years, i could afford the rent, i could even afford a mortgage on it but is there any way for my mum to get the house into my name as it is a council property without jeopardising her chances of getting the 2 bed she requires. I want the house so bad. Thanks for any advice
I think you would have to be down as living with her for like 6 months or something, have your name on rent book etc.
But if you wanted to but it i think they have strict rules that you yourself would have to be living there for so many years...
Have you looked on council website?
Surely she requires a 1 bed?
If she has had her name down since she moved in, she could pick nearly any house she wanted (not designated for priority that is).
You need to have lived there so long and transfer the tenancy.

I took over my mum's tennancy some years ago but that was allowed because she got remarried and moved in with her new husband, therefore not requiring a new tennancy. If she is moving to another council property then I would have thought that she would have to give up her existing tennancy otherwise everyone would be trying it to get another house.

If the OP was to buy a smaller place, rent it to his mother, and have her pass the council tenancy on into his name ... would that work?
I'm fairly sure that you cannot move from one council property into another one, and still pass on your former one to someone else; but what if you're coming out of council housing altogether (other than by dying)?
Maybe me buying a 2 bed house and renting to my mum whilst she passes over tenancy is the only solution? And she is wanting a 2 bed not 1 as my younger sister is still at home

If a tenant is leaving their tenancy permanently and they have not succeeded to that tenancy they may apply to assign it to a member of their family. That person must have lived with them for the past 12 months. The appropriately authorised Manager in Sheffield Homes must give agreement in writing before someone can assign their tenancy. Agreement will only be given to a tenant to assign the tenancy of their home if the tenant is:
a. transferring for medical or disability reasons and the new home is not large enough;
b. moving to somewhere they will be cared for, such as a residential home;
c. going to live with a new partner and neither the tenant's home nor their
partner's is large enough for the potential assignee to live with them; or
d. moving to a different part of the country and the potential assignee has strong links with Sheffield, for example they work or study here.
In addition to this a tenant will not be allowed to assign the tenancy of their home if it means it would be greatly underoccupied. So in the case of a 3 bedroom house this would mean a family with at least one child or 3 adults.
