View Full Version : Accident Claiming Advice
Hi today I had a accident while out on my Mobility Scooter,I was travelling on the path from my house,I had gone approx 50 mtrs from my house when a car approached at a junction to my right,he saw me & he pulled up outside his house & he got out of the car, then the passenger side door came open & smashed into my right knee & ankle ,the person who got out of the passenger side was his 10 yr old daughter who I could not see in the passenger seat as she is small.I am going to the A&E to have a xray as my right knee has gone stiff & swollen rather badly.As the driver saw me & did not tell his daughter to keep the door shut until I went passed,is he liable for my injuries on his car insurance. I am alway's alert for car doors opening while travelling on the path but like I said I did not see the child.,I am not 1 of those who make's claims so I do not understand the system.
Knoxville 05-08-2005, 12:35 Shoudn't you be more concerned with finding out whether any damage has actually been done (to you) rather than immediately thinking about how you can make a claim.
It sounds like an accident to me - plain and simple - why do you feel that you should be compensated

Mind you, what are you going to do with a Barbie doll, a My Little Pony and a pair of pink roller skates?
NatalieSheff 05-08-2005, 13:10 want ever you do dont go thru an "accident group" type company. go to a proper solicitor if you have sufficient injuries. maybe id talk to the man and if he could nt give a bugger, then id think about claiming, but if he was really sorry and had a million things on his plate then maybe i wouldnt.
dont claim for the sake of it, only if you have to

I very much hope not.
Whilst my area of expertise is investments not personal injury, I'd say you could only claim if you could prove some kind of financial loss from the accident. e.g. time off work, repairs to your mobiliity scooter etc.
That's my (semi) professional opinion but personally I'd say let it go mate. Don't join the ever-grwoing throng of people who sue / claim at every opportunity.
I'd also imagine it would be nigh on impossible to prove negligence against a 10 year old.

Yet as soon as you have an accident you inquire about them. I really wish people would stop claiming for everything.

Please tell us what the driver did when the accident happened.
Thanks too you all for the advice & some making me out to be some nutter who go's around looking for an accident to happen so I can claim off them.I know that I have hurt my knee & ankle but I told my son I would leave it while tomorrow to see if there is any improvement,I cannot take anymore medication for the pain as I already take the strongest I can take.As for the driver he came around the car & asked if I was ok,I said let me get over the excrutiating pain & I will have a look at my leg,but the driver is a member of a family who I have not got on with for over 5 yrs.Like I said he saw me & I am not blaming the little girl she was very upset & whilst I was in terrible pain at the time I reassured her I would be alright.Thanks to everyone.Tosh13

Accidents are just that - accidents. There isn't always someone to blame.
6 years ago I was in my wheelchair & went down a pothole in the pavement & badly damaged a shoulder ,while everyone was jumping on the band wagon I did not,but I am sick of stupid people not watching what they are doing,He saw me & his little girl was in the front seat,which I thought was illegal when a air bag was fitted anyway. & no I am not asking about suing him because of family histories.I asked if he was responsible for any injuries his vehicle caused to me,surely there should be child lock's on car anyway.like I said thanks for everyone's advice but I will not be suing the guy or his child,so all can sleep well tonight except me .Thanks & Goodbye.

i have had a few big accidents whilst working for a very well known company and did not sue them as it was an "accident"!!! let it go mate as its not worth it and if you dont get on with the family now how is it going to be once you submit a claim?? they would need to pay you as i doubt they have insurance for this sort of thing!
40summat 05-08-2005, 19:10 I can emagine how you must feel tosh if someone slammed a door into me my feelings other than pain and shock would eventually turn to anger thats pretty normal i supose.
It's obviously worse for you as you must have to face an obstacle course on a daily basis.
I may be wrong but it sounds like you were letting off steam and theres nowt wrong with that either, the girl will have learnt a lesson anyway!

Thanks for the understanding & it is a bit rough sometimes dodging cars on the pavement,wheelie bins,skips etc & yes I guess I was just angry at the time,but it was my good leg that got hurt & is still sore & stiff this morning,but with rest it should be ok,but I had had a rough night.Tosh13
