I did not get much information on DVLA website so i am posting here. For traffic offenses points stay on the license for 4 years and are valid for 3 years from the date of the offense.
pls advice me on this points

(1)
suppose u 've got 11 points now and u 've got a FPN (fixed penalty notice of 3 points and 60£) . how long u ve got to wait to apply for provisional .(full license is revoked under the totting up scheme).

(2) u ve got 11 points on license , 8 points on11 th july 2002 , 3 points on later date .. In this scenario do u consider urself to have 3 points or 11 points . what would happen suppose if u were to recieve a FPN at this juncture ,as u ve finished 3 year period

To (1) I'm not sure.

(2) You have 11 points, the FPN will take it up to 14, but you would not lose your licence under 'totting up'. The first 8 points would then 'disappear' on 11 July 2006.

If you've got that many points, I'd take it as a hint:
You're not a great driver, buy a bus pass!

(1) It depends. If you fall foul of the totting up rules you get disqualified for at least six months, maybe more depending on what you did.

(2) If you got three points for an offence committed today (12/07/05) then the eight from 11/07/02 would have expired under the totting up rules. If you got the notice today then the offence probably happened on the 11th or earlier. If it was on the tenth or earlier, totting up comes into action and you're disqualified for at least six months. If the offence was on the eleventh, I'm not sure, consult a lawyer.

is it really for as long as 6 months, I thought (for some reason) that it was 56 days.

why wouldyou want to apply for a provisional if you held a full one unless you have been ordered to resit the test.

Exactly. Unless you were ordered by the Court to re-take your driving test, you do not need a provisional - your full licence will be restored to you after the banfinishes.

I also agree with md25. It depends when the offence was committed - if before 11th July, then you will have 14 points and get a ban.

I got banned for getting 6 points (due to only having just past my test) and they revoked my license, and I had to take the test again, which I could do straight away. Im not sure if this applies to your situation too.


Heres a question though. Does anyone know what happens in this situation.......

If Ive just recently paid a fine and got 3 points which take me to the limit where you get disqualified. I presume you are not disqualified until you have been sent a letter from the DVLA. So can you continue to drive up until you get the letter, and what happens if you dont get this letter (or maybe you have but they dont know that), can you still sort of legally drive?

My paragraph doesnt seem to make much sense now that Ive read it back to myself but hopefully youll know what Im going on about.

This Act will affect you if you passed your first GB driving test after 1 June 1997 when it came into force. If the number of valid penalty points shown on your driving licence total 6 or more during the two year probationary period immediately following your first driving test, your full driving licence will be revoked by DVLA until such time as you pass a further driving test.

Such drivers should apply for a provisional driving licence if they wish to continue driving and are subject to "learner" conditions until they pass both theory and practical parts of the driving test
SPYRO2000 :from DVLA website , it says u should apply for provisional not just retake the test.Maybe u ve been given option to retake the test by court .

I got 11 points at the moment and 5 points would come off next march .I am about to graduate in civil engg. in 6 months and will be looking for work in construction industry. some employers are asking for clean driving license . I was thinking of the option of getting a FPN purposely (3-6 points +60£) . At this point do i need to apply for provisional or straight way take a practical test or wait for certain period before taking a test . I am just looking for options to get clean license before I apply for jobs.I am not crazy and perfectly in good state of mind but just looking to get full clean license before i apply for jobs in january. I wouldnt mind if i was disqualified for shorter period (in my case it shouldnt be for more than 6 months) . 11 points were for speeding on M1 on two occasions. I was lazy to go to court and plead for fewer points.

Think of how much your insurance premiums would go up though for having received a driving ban!

after you've been disqualified for a certain length of time the points are removed.
The driving ban is presumably put on your licence when you get it back, so it's not a clean license.
