The Police turned up this afternoon whilst I was feeling sorry for myself on the sofa after having wisdom tooth out this morning.

Apparently my landlord has been involved with a hit and run accident in London and his car is still registered as being here.

Scared the life out of me with Police turning up! I've given his mobile number to the Police (not sure if I should have done that)

I've sent him this text message (I can't phone him 'coz I can't talk properly today with the old wisdom tooth!)

"...Please can you change the address where your car is registerd. The Police have turned up looking for you. I have given them your mobile number and expect all addresses to be changed and the legally binding gas and electric checks to be done ASAP as we are seeking legal advice"

If you've seen my previous post in the housing section I'm in a battle to get the gas / electric / energy checks done too.

Oh and if I want the LEGAL gas and electric checks doing the rent is going up by £250 a month.in that case get a solicitor to act on your behalf, i dont know who you would take any complaint to but there is a law stating that all gas appliances should have a certificate of safety & if his have lapsed then he is liable it seems to me as if your holding all the aces so to speak

He hasn't changed his morgage or informed his morgage company he's renting, no insurance, the DVLA are after him, our deposit hasn't been put in a scheme and above all else he's threatening to come round and kick us out the house - should I log this with the police Just incase something does potentially kick off?

He can't come and kick you out. Any actions like that (unofficial eviction/ changing the locks etc) are highly illegal. Call the police and tell them you are being illegally evicted immediately if he tries any of that. A section 21 notice must be properly sent to you giving you 2 month's notice starting from the date of a new rent period. If you don't leave on that date, he needs to apply through the court for an eviction notice and if you receive that you may have 2 or 3 weeks from that date too.

I've done a lot of research into tenacy law this evening and spoken to a few reputatble landlords I know and they have suggested I report him to the Police for the threats of kicking me out - what do you think?

report him for the threats etc but try and find somewhere else sooner rather than later...

keep a diary of threats by landlord and contact you have with him.
Do you have a tenancy agreement ?

Shelter website as lot of good advice on it. I would also go to CAB or get yourself some housing advice.

Yes i would move out.

Thank you for your advice guys, I'm really glad you've responded. I'm gunna attack him from every angle with this - he's treated me like the "little silly woman" if you know what I mean and NO ONE talks to me like that. He'll only speak to my OH about problems and issues because "hey! what does a woman know right(!)"

seems like an unregistered landlord which in itself is illegal too. There are all sorts of tax implications with tis, so if he threatens you again, find out who you need to report this to and he will soon stop threatening you because he probably will end up owing thousands. I'd get with a proper managed letting agency as soon as you can cause this guy sounds like a proper pr*ck!!!

I think you should probably leave before the cooker blows up or debt collectors turn up looking for him or worse he turns up and gets violent.

You've reported him to the police, they're already looking for him for something else, he's clearly dodgy as they come, so get out whilst you can.

If you've paid a deposit then just withhold the final months payment as I'd guess you're unlikely to ever see it again. And if he's in London he won't be just popping around, he'd have to make a special trip to try to kick you out.

I'll second that, i know you have settled in but do you really want to keep paying money to this person? He can't just put the rent up, and even if he was considering a rent increase it can't be by as much as that in one go!
Put everything in writing to him, and keep a diary of every conversation/text message in case you need to refer back to it later.
Also, have you contacted Shelter or the CAB for advice?

We have the same with my landlord and almost the same issues. He thinks im just some obnoxious moron complaining about having no kitchen and safety certificates and nearly blowing us up. He thinks he can ignore me and that my partner will agree with him. With me being a mere woman. You are better off moving somewhere else.

I would move out ASAP and make sure you keep your last months rent as it doesn't appear your going to get your deposit back.

Get out asap!

If he does come and kick you out illegally the police will do nothing

I have personal experience of this and nearly a year on I'm still fighting to get my stuff back

If your landlord hasnt protected your deposit and he should have then you could look at the option of applying to court in order to sue for compensation - 3 times the deposit you paid and they will enforce the landlord to also return or put the deposit in a tenancy deposit scheme.

Also, important thing to note!!! If the landlord hasnt put your deposit in a tenancy deposit scheme any section 21 notice (eviction notice) he serves you is invalid and this can be submitted to the court.

To pursue any court action against your landlord you would need his address.

As people have said there are other things re: gas safety checks and possible illegal evicton so take advice and get someone to possibly contact him for you.

I really wouldnt worry . If the police are after him hes hardly likely to turn up threatening you. If he does just call 999.

And wait together for a pleasant 30mins to 2 hours....:huh:
Not a great survival technique, getting yourself in dangerous situations then relying on the super plod to come and bail you out.

As said I'd pay and keep things simple. I had a couple of mates who's landlord went on the run so they decided to go the rent free squatting approach...it didn't really end in their favour.

I am so sorry you are having all this trouble!! You do need legal adivce sooner rather than later. If he hasn't informed his mortgage lender, and fails to keep up the payments, think I am right in saying, they can take the house.

I love a drama!

Its like a soap opera. If anyone is interested my friend who works at The Times newspaper might be publishing the whole saga, no idea when but if it does get published I'll post a link.

We are moving out on 1st July, had enough of all of this, just going to go live in a crappy flat it town most likely - not that we've organized it yet, still got viewings booked for tomorrow. Oh well, I really liked Lodge Moor, I knew it was too good to be true. Ce La Vie.

send him a letter saying your solicitor wants to speak to him with regards

After getting legal advice I am to totally ignore the idiot and let him spend money (he doesn't have) and then counter sue. For an academic this man isn't very intelligent, goodness knows how he became a "Dr" at a University.

Hopefully his solicitors have said "err... you don't have a leg to stand on" and that will be the end of it.

I presume the court paperwork has his address on it.

If it does, I feel it is your public duty to pass this information on to the Police.

Furthermore, you may want to contact the Inland Revenue because if he's not paying his taxes, it's your public duty to report it.
