View Full Version : Drink driving penalties? sarah_d 17-06-2005, 13:15 .................................................. sarah_d 17-06-2005, 13:28 .................................................. ..................................... Shiesh 17-06-2005, 13:42 I would imagine if you are guilty of drink driving and as a result have either injured or killed someone you will be subject to a criminal prosecution in a court of law. I wouldn't expect a fine and a few penalty points for this offence. :o Dj_Shadowman 17-06-2005, 13:43 Go to this site : http://www.5ive-o.com Get onto the forum, im sure someone will be able to tell you as they are all plod :D sarah_d 17-06-2005, 13:57 .................................................. ........................................ dylan_61 17-06-2005, 14:11 Friend of mine crashed his car into parked cars, whilst drunk and was lucky to escape a custodial according to his solicitor. Another guy I know was chased by the police, whilst drunk. He was sent down for three months and got raped in prison. I wouldn't worry too much, not everyone gets that kind of treatment chickmonk 17-06-2005, 14:14 I've asked about this at work (the peeps here know stuff). They say - would depend on - amount of alcohol consumed - whether the person stopped at the scene - injuries victim sustained - previous conviction of driver etc etc Custody, they say, is a real possibilty but obviously dependant on the circs. owdlad 17-06-2005, 14:14 Another guy I know was chased by the police, whilst drunk. A ban is an absolute deffo on this one,,but I would be talking to a brief first. sarah_d 17-06-2005, 14:33 [.................................................. .................................................. ... dylan_61 17-06-2005, 14:36 Originally posted by sarah_d I want him to!The guy who run my partner over recently had had too much to drink, did stay at the scene but only 'cos he was slightly injured and couldn't get out of his car that was smashed up. He'll go down. Take civil action against him as well. Nice little pay day for you. That'll be an easy case for you to win Saxon 17-06-2005, 18:10 The applicable penalties can be found here (http://www.highwaycode.gov.uk/28.htm#5) Cyclone 17-06-2005, 19:52 do they charge you with the worst offence, or with all the ones they can? Either dangerous driving, driving whilst under influence or both in this case then. Max penalty for dd is 2 years/unlimited fine, max for dui is 6 months/£5000, both are an obligatory ban. Was it a nice car? I wouldn't bother taking out a civil case unless he has something to pay the damages with. sarah_d 20-06-2005, 09:15 .................................................. .................................................. .............. |
