I would imagine if you are guilty of drink driving and as a result have either injured or killed someone you will be subject to a criminal prosecution in a court of law.

I wouldn't expect a fine and a few penalty points for this offence.

Friend of mine crashed his car into parked cars, whilst drunk and was lucky to escape a custodial according to his solicitor.

Another guy I know was chased by the police, whilst drunk. He was sent down for three months and got raped in prison.

I wouldn't worry too much, not everyone gets that kind of treatment

I've asked about this at work (the peeps here know stuff). They say -

would depend on
- amount of alcohol consumed
- whether the person stopped at the scene
- injuries victim sustained
- previous conviction of driver etc etc

Custody, they say, is a real possibilty but obviously dependant on the circs.

do they charge you with the worst offence, or with all the ones they can?

Either dangerous driving, driving whilst under influence or both in this case then.
Max penalty for dd is 2 years/unlimited fine, max for dui is 6 months/£5000, both are an obligatory ban.

Was it a nice car? I wouldn't bother taking out a civil case unless he has something to pay the damages with.
