we have tried to cancell our contract after less than a week and the phone has not been used at all. the company have told us that we cannot cancel our contract even though customer services told us we had a '2 week cooling off period'
Arnt there any laws on this?!???
AND
do u think we all REALLY need mobile phones??

get you contract out and read the small print, it will then tell you if you have a cooling period or not:thumbsup:
you should have a copy of the contract that you signed. read the small print, it should say something about this two week period!
I'm pretty certain that you should have a two week cooling period and the only time that you don't is if you do an upgrade on an existing contract.
If you want some genuine and good advice, go to the carphone warehouse on fargate.

you are able to cancel your contract up to 14 days from taking it out if you have used it or not. you are covered under a few regulations the first been the credit act 1974 and the sale of goods act. the only was you wopuld not be able to cancel is if it is written in the contract you signed but as it is a form of credit then the law sates that you have that 14 days
if you still have no joy tell them you will take it to a solicitor and let them deal with it and you will bill them for the whole costs. thant will work i am sure
If you bought the phone in a shop, then I fear you have no way of cancelling it.
If you bought it online or by phone, then you can cancel it under the European Distance Selling Regulations. Additionally any insurance you have purchased will be covered by a 14 day cancelation period.

If you bought it in a shop then it should be easier, really. Just take it back to them. Most shops I know off, both the independant and network specific ones, allow you to return the whole shebang up to 2 weeks after purchase.
Sometimes all it takes is to just call again; you can get some real pains working on telephone support who just want to make your life harder :rolleyes:
You may not be enititled to cancel... Not 100% sure but I'm almost certain that mobile phone contracts aren't affected by a consumer credit agreement. I used to work for Vodafone and at one time they had no 14 day policy when bought from a store - the only time 14 days was applicable was when ordered from telesales due to distance selling rules.
Contrary to popular belief (check something like trading standards website) if you buy something from a shop they are under no obligation to give you a refund becuse you change your mind.
Vodafone also offered/offer 0% over 10 months for expensive phones, and this was obviously part of the CCA as the documents signed stated it was, but the contracts for phones never did. When you take out a phone, you buy or are given the phone free - technically the line rental is what you are paying for not the phone altho the monthly rental subsidises what you piad for the phone. The phone is your property and if you default on payment they won't be arsed about having the phone back, just your 12/18 months @ £? a month.
I agree with otto... I work for a mobile network and there did used to be 14 days in which to change your mind. This is no longer the case, unless as Otto says you purchased the phone over the phone or via the internet. In this case you have 7 days to return the phone under the Distance Selling Regulations.
Having said that, some dealers will allow you to return the phone but this is at their discretion and they are not legally obligated to do so.
Distance Selling Regulations only give you 7 days and you have to put it in writing

You can also request to return the phone under DSR by email and fax as well as letter. Well, you can at our place anyway :)
