I booked a holiday with Thomas Cook in town about 3months ago, me, my boyfriend and his brother, payed for a 4* all inclusive hotel to Greece, today (3days before we fly) they rang to tell me that they have moved us to a different hotel which they told me was a 4* but i have since found out is a 3*, they told me the hotel i was orginaly stayin in is closed on the dates i booked as not so many people have booked, which is obviously a load of rubbish, my mum dad and aunt have said its obvious they have doubled booked, should i complain and should i be able to get some kind of compensation?

i once had something similar to this happen to me. We were told about 1 week before going away that the holiday we had booked didn't have enough people booked in to make it feasible and we were offered something else. That holiday had been booked about 6 months. I think they leave it this late so you feel pressured into taking the alternative instead of cancelling and getting a full refund.
If i were you i would write them a letter with your complaints and also let them know you will be sending the same letter to ABTA if you do not get a satisfactory response and some recompense. You will have to read the small print carefully in the back of the brochure to see what you are entitled to. Good Luck!!

Holiday companies try and get away with all sorts, writing so many exclusion clauses into their T&Cs it's unbelievable.

To get slightly into contract law, you could argue that they sold you the holiday under a misrepresentation- you bought the holiday originally believing a 4* hotel to be involved and now you're getting a 3*.

Try kicking up a fuss, as Caz said, threaten them with ABTA and undertake a little reading so you sound clued up. Usually just sounding like you know what you're on about gets a good response, even if you don't really :)

This has happened to us too. They offered us alternate accommodation but we didn't want to go there. We went back to the shop and trawled thru' their brochures looking for an alternative hotel that suited US not them. They have to offer you accommodation of equal or higher standard and it should be at no extra cost to you. We also received compensation of £300.00 because of the late change of holiday details from them. Read all the small print in the back of the brochure and find out exactly what you are entitled to by way of alt. hotels and compensation.
