View Full Version : Parkway (Housing Association) Tenancy Transfer

I was wondering if anyone could give me some advice.

I am a tenant of a property let by Parkway Housing Association. I moved in with my (now) ex partner in December last year. We were given an 'assured' tenancy as the property had been transferred from Sheffield Homes.

However, on Monday 28 July 2008, my ex partner left the property and signed a new tenancy for another property with Sheffield Homes.

Upon contacting Parkway Housing Association, they have advised that as my ex partner has left the property, then the whole tenancy will end, therefore leaving me homeless.

I have been advised that this is their 'policy' but they are still looking into it and will contact me on Monday 4 August 2008 with a final decision.

Does anybody know if what I have been advised is accurate?? I would have thought that even if one person on a joint tenancy leaves, then the tenancy would transfer over to the person that still lives there.

Any thoughts, ideas or responses would be appreciated.

Hi there

As a general rule if you have a joint tenancy and one person hands in their notice then it terminates the tenancy for both parties and this would mean you were kinda there with no tenancy anymore.

Check he has handed in his notice, if he has try to get a copy to see if can argue that its a valid/invalid notice. If you can stop him handing in his notice or argue its wrong then you could possibly try to assign the tenancy from joint names to one name (the transferring of a tenancy but this doesnt happen automatically).
