View Full Version : I've been made redundant! Is this right?

Was made redundant on thursday to finish on 24th and be paid until 10th. Went all out looking for another job and have found one on the condition I start thursday this week. My employers are now saying they don't have to pay me past thursday. This seems ridiculously tight since it was their fault I had to look for another job. Is there any way round it?

It's a bit naughty, but I can't see how you are going to get round it... if your contract says you have to give a month's notice and you are only giving a couple of days, then I think they'd just use that against your reasoning that it's their fault. Unfortunate, and pretty mean of them I'd say.

Congratulations on the new job by the way.

I think redundancy is a bit different from handing notice in. I can see a couple of options:
a) explain situation to your new employers and see if they'll delay your start
b) tell your current employers you've changed your mind, but go mysteriously sick after Thursday (believe you can self-certify for up to 5 working days and there's nothing they can do about it(?))

Either way, I'd speak to a union rep if you have one or the CAB to get real expert advice.

No because my contract states I must be given a month's notice. I just happen to have found a new job that requests immediate start within the month's notice

Our firm found out that someone had done a similar thing to us (handed notice in, then went sick and started new job early). When we found out, we wrote to her to say that as we believed she was working a second job while signed off sick, we wouldn't pay her for those days she'd missed. We invited her respond, but she never bothered, so we didn't pay her.

So maybe Hotphil's idea is best... you could try telling your current employer that you have delayed your start date. If everyone is being made redundant, I can't see anyone wanting to put too much effort into tracking your employment movements! Also, it depends when the pay run is.

Sorry, not much help again!

That's been lots of help thanks. May be off for a sick note - it's 5 days work difference and 3 weeks pay difference so all I would be missing would be 5 working days. What are the chances of being caught out?

your company is legally obliged only to pay you for your notice period or in lieu of notice.if you are fortunate to find employment prior to that your employers obligation ceases when u start your new job.
however your employer must still pay all your holidays & redundancy owing.
therefore take one weeks holiday from your current employer, ie from thursday. if you have the entitlement & keep quiet whilst you start your new job.
